Claimants don't file defences unless, in this case,  you have counterclaimed. More likely the Claimant has to file proper POC but until, as @Coupon-mad writes, we see the judge's order in detail, we don't know.

Wow you should buy a lottery ticket!  This is how not to do it but you won!

As far as I can tell from that, you didn't file & serve a recent WS nor evidence (in support of your defence of the PCN) before the hearing and didn't attend. By rights you should have lost and I don't understand why you didn't supply a WS or show up?

    But hey ... well done!

    ANOTHER ONE BITES THE DUST!

Hi, to say it went topsy Turvey is an understatement,
The letter for the court date arrived after the date?
I do find it strange that all the courts cannot collectively use the moneyclaim website to digitally update court dates etc given the post can be so unreliable?

I'm just glad that common sense has prevailed , but would also like to see if my case could help others with the poor quality photo evidence too?
  • Hello,

I have read the newbies thread and FAQ, and can see the template response advised, however I have just received a parking charge notice from premier park for overstaying in a retail park by 13 minutes, it’s not a paid car park and wasn’t even aware their was a time limit, my question is, is there any point in appealing as most of what I have read is they uphold their decisions, if I ignored would they actually take me to court for £90, thanks

Yes they might so just get the retailers to cancel it, which ALWAYS comes as Plan A before any appeal, as you will have seen in NEWBIES PLEASE READ THESE FAQS FIRST.

  • Thanks, I will try and find their info to complain, if that fails then it’s the appeal to Premier, and then if they uphold just ignore further correspondence?
