Hi,
I've emailed courteous letter to the solicitors and parking company, notifying them of their error ? No response,
I complained to the hmtcs whom replied I can reinstate the hearing for a fee of £108...
This whole saga is an absolute nightmare , you cannot get hold of any customer services at the business court, to date I have not been notified of any decision made by the court only myself checking the money claim website daily !
It's literally a cash cow!
I have received a subject access request from the parking company, and got the evidence directly ..
Would you propose to have my evidence reinstated and pay the fee ?
Would the fee be refunded ?
And can I invoice the company for my time/damages?

Do you mean that the PPC have submitted a SAR to you; what data do you hold about them? I have recieved no response from them or their solicitors..so have paid £108 and filled a m240 form to have the defence reinstated at the County Court business centre ..

...which for CCJ set aside applications (where the C refuses to consent) is always to pay the higher court fee (£275) so that your application results in a hearing.
I sincerely hope you supplied enough evidence to convince a Judge, if you are expecting a decision without a hearing.
It's absolutely not what we recommend as you can't influence the decision and a lot of Judges would take a dim view of the circumstances of a Defendant failing to respond to the Order for Directions Questionnaires...
You might get a flat "No". £108 wasted. Reinstating a defence is hard. Not a shoo-in.

But that's not really what your application is about. Your application needed a witness statement & evidence to show good reason under CPR 13.3 why the defence should be reinstated and what happened re the missing DQ.
What order did you ask for in the N244 and what evidence did you attach? Did you attach the missing DQ and explain about that? What did your witness statement say?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
