Small County court defence template - Private Parking ticket
Thanks I got it, I'm a bit slow when it comes to these things so thanks for your patience. I found the thread detailing how to fill in this questionnaire but it seems to be missing the below question. Which option to choose please ?
Does the case being transferred to county court in Birmingham mean I can expect a hearing soon ? Also I had to email them DQ three times before they processed it. I've got the received receipts from them as proof so I hope judge doesn't use this against me.
It means you can expect to be doing your WS & evidence soon. As is covered in the NEWBIES thread in the section under the red heading starting with the word 'IMPORTANT'.

Why did it take almost two months for the claimant to request a lifting of the stay? Was the defence acknowledged by the claimant? Was the defendant served with a copy of the application to lift the stay?
There is far too much of this unnoticed lifting of stays, whether they were due to clerical errors or otherwise. Once a claim has been filed, it has entered the "system" and anything that can affect either party must be notified to the other.
I am about to start corresponding with the management of the CNBC to find out the process that is being followed and whether any Court Procedure Rules are being breached (I suspect that they are), in particular where clerical or administrative errors by the CNBC are being ignored through abuse of process by allowing claimants (serial roboclaimers in particular) to have stays lifted without any due process or notification to the other party.
I intend to try and get enough information on the processes being followed by the CNBC which clearly do not follow any CPR but ultimately put the defendant at a disadvantage in the process by not being able to challenge or consent to application by the claimant once the claim process has started.
Should there not be a satisfactory explanation or it is shown that the legal process is being flouted or ignored, I will attempt to raise enough to get a Judicial Review.
Simply brushing off these lifting of stays as clerical errors by the CNBC as being inconsequential is not acceptable.
Thanks @Coupon-mad@LDast and @KeithP I will call them again tomorrow to ask why it doesn't say the defense is reinstated. It's really frustrating as I've already called them at least 3 times before and waited over 30 minutes before they answered. CBNC are really incompetent like LDast pointed out and it makes the whole process more painful than it needs to be.
I need to write my witness statement and gather evidence for my hearing on 17th October. I know this is under newbie thread but I can't find it so can someone send me link to this thread please ?
