I had a reply today confirming that they have charged dca on my agreement. It states that if I want to make a complaint, I should contact them! My original email (using the template supplied) stated that it should be treated as a complaint. So I emailed again confirming they should treat my original email as a complaint, and my subsequent email as a follow up to the complaint.
I originally contacted them in March, so taken 2 months for that.0 -

I sent the templare letter in Feb to both BlackHorse and Jaguar Financial Services (in relation to the financing of my Jaguar iPace). JFS are owned by BlackHorse.
I received acknowledgment from BH very quickly saying they were looking into it, then yesterday I received a cheque from JFS. No explanation and no idea if its correct only a one liner that said 'In response to your recent request, we have the pleasure in enclosing a refund cheque'0 -
Its been over 89 days and inbetween those days I have received the same email about 5 times saying "We are still looking into this motor commission request" Also called them twice to see if they had any updates, again both said you should get a response soon. So I have emailed the Ombudsman to see if they can help, will see if they have any update on this middle of next week (29th May 2024). Hopefully i will get some more information, sounds like Black horse is dragging its feet!!!0

They are not dragging their feet - the FCA review will not finish until at least September (maybe even much later) and until it does, there is no possible outcome. The FOS will most likely tell you the same thing.
Remember, DCA at point of sale was perfectly fine for the laws at the time, therefore they did nothing wrong. Now the FCA has decided this might have been problematic and instead, should be investigated and if necessary, apply a retrospective rule and punish firms who used it. However, they might decide that as no rules applicable at the time were broken, there was no wrongdoing and this whole thing can be shut down. Thus, BH would be out of pocket if they investigated it and paid out.
Have some patience, if you were miss-sold you might get some money back, but not until after the review.Sam Vimes' Boots Theory of Socioeconomic Unfairness:

Ive received a letter from Blackhorse today confirming that we did have DCA on our car loan.
I guess that's great and all I need to know? I guess I need to wait until after 25th September FCA decides on how much the payout will be?
I can't see it being much as I paid off my loan must earlier when we sold the car on and cleared the finance.0 -

At this point you only know that the dealer operated DCA. You don't know if they actually used it or if they did use it, did they use it positively or negatively.

Dealers are making their case about the finance being part of the package and how DCA could be used to move the profit from the car to the finance to aid the sale.
If the FCA decide that negative DCA is wrong but your dealer didn't use DCA in your case or used it positively, then there is not pay out coming your way.

I also filled in the online form in January I have now had 4 auto generated letters as above thread. I phoned the number on the letter and the woman I spoke to did not have a clue what I was on about and kept telling me to hang on. She could not find any record of my request and then said it’s being g dealt with now that’s why I can’t see it on my screen. It feels such a waste of time even bothering0

Until then, the FCA has suspended any complaints on DCA and companies do not need to act on them.I am an Independent Financial Adviser (IFA).
