If you would have the ability to exam a demo model in store then you have the same degree of right to examine the product at home - you have the right to decide to accept or reject the product on the same basis (using the same amount of information) as you would in store.sheramber said:
Would you get to open the box and break the seal in the shop , or would you be shown a demo model rather than opening the box of the one you buy?LightFlare said:If it’s a true distance sale then you are allowed to examine the product to the same extent that you would be as on a premises.
If that means you have to break a seal to enable you to do that, then so be it.
Did you order AND pay for it remotely and just collect from the shop ?
This will form the basis for whether it can be classed as a remote purchase.

Did you use "live chat" or did you actually telephone them on 0345 6402020 and try to speak to a real person?pepsik said:live chat will not collect as it was collected in store the email address just bounces back do I just have to accept this
Assuming you can get through to someone tell them that you are exercising your statutory right to cancel the contract under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (legislation.gov.uk).
Emphasise to them that you are exercising your statutory right to cancel a distance contract and that you are not trying to use their own returns policy.
Your statutory right to cancel permits you to open the box that the laptop came in in order to inspect it. Argos' own "rules" cannot stop you doing that.
If you really can't get anybody to see sense on the 'phone you might have to go back to the store. If that fails come back here
How did you pay? Debit or credti card?2 -

Have they sent you a transcript of this live chat where you explained you wanted to cancel the contract under the regulations but they refused?pepsik said:Thank you for your responses they have just said as the box is opened they cannot/willnot help it just needs a bit of HP tape so I am at a loss0 -
            Did you get an email from Argos stating your order is ready to collect? I've just checked my last one and within that email it states:
If you’ve changed your mind and need to return an item, our returns policy applies to most items. You’ve got 30 days from the day after the date of collection or delivery. The Consumer Contracts Regs 2013 gives the right to return most goods purchased by distance without giving a reason. Some items are excluded. For example, you can’t return: • Goods which might expire quickly;
• Goods made to your own specification;
• Goods sealed for health or hygiene reasons, if unsealed;
• Audio, video recordings or computer software, if unsealed.You need to return any collected items at your own cost or, if the item’s been delivered, by contacting us within 30 days. We’ll refund payments for returned items including outbound standard delivery charges, if all items in an order are returned. We reserve the right to charge for return delivery. If the returned goods have lost value due to unnecessary handling by you, we may make a deduction. Refunds will be made to your original payment card within 7 working days of us receiving the goods.

OP as above check your email, Argos are pretty poor at this and are sticking to their policy rather than your right to cancel, if you have the same in the email point customer services to the email they sent.powerful_Rogue said:Did you get an email from Argos stating your order is ready to collect? The seal would apply to software and such as they could be copied then returned, it certainly doesn't apply to laptops.
If it was that easy every item you bought would have a seal and every change of mind would be rejected on the basis the seal was broken.

            Can you copy and paste what it says OP (or better a screenshot) but obviously without any personal info?
A PC/laptop isn’t excluded from the right to cancel even if opened, etc, the hard part is driving this home to Argos.If you aren’t getting anywhere and want to write an old fashioned letter to their head office I’m happy to draft one for you?In the game of chess you can never let your adversary see your pieces0
