I need help getting a refund from Argos with PC

I purchased a HP lap top online from Argos on my store card I gave it to my daughter who opened the box on her 18th birthday she looked at it asked if I had the receipt I did she wanted a 15.6" with a bag I ordered the one she wanted put everything back in the box my husband went to the store they refused to refund it as the box was open I have called their customer services they will not  help. Whar are my rights please help I dont know what to do thank you

    Was the purchase entirely online, paid before delivery or collection from a store ?

    Did you attempt an online return before taking it to the store ?

    As above, timeline is vitally important.

    Argos T&C state:- 

    If you've changed your mind and need to return an item, you have 30 days from the date of collection or from the date of delivery to return your item(s).

    Your item(s) needs to be:

    • Unused and with all original components
    • In its original packaging (with the tags if applicable)
    • In a resaleable condition security seals intact (where applicable)
    I'm sure others will be able to clarify if the way you purchased is covered by the distance selling regulations or not.  If not, it would seem you have failed to comply with their requirements.

    There was a thread on here from January 2023 where someone had similar problems, the gist of it, Argos showroom said no, Argos Helpline said no, Social Media Team said no and the author was off to email Argos.  They did not return with an update which is frustrating. 

    I do hope you get it sorted but Argos are going to have to list it on eBay at a reduction as box opened as I certainly would not buy it from the store.  If all else fails, maybe your daughter will get to like it.  To me, its a bit of plastic with buttons and a screen.  They all do the same thing really but I know what some people can be like with brands, features etc especially as it was for her birthday.

    If it’s a true distance sale then you are allowed to examine the product to the same extent that you would be as on a premises.

    If that means you have to break a seal to enable you to do that, then so be it.

    Did you order AND pay for it remotely and just collect from the shop ?

    This will form the basis for whether it can be classed as a remote purchase.
