I was just about to comment when I seen your additional comment about your housing benefit. You need to ring your local Authority because if your HB claim closes you will not be able to reclaim and then you will have no option but to claim UC for help with your rent.
You should also ask them if they can recalculate it based just on your CB ESA for now, if your claim is only suspended.1 -

I would rather write a letter as well as honestly they are not the best to speak to, even easy things
How can I word it though? Everything needs to super simple for them. I was just going to write to them to inform that we are in the process of claiming the IR ESA and that we intend to stay on the legacy benefit system.

There may still be some entitlement even though it's CB you're claiming for now. The reason for me advising to ring them is because you really do need to check that it hasn't ended completely. If it has then you will need to claim UC as soon as possible.
All you need to do is ask if your claim is just suspended and could they recalculate it based on your CB ESA as that's your only Income for now.1 -
I'm sort of in the twilight zone as I'm waiting for the IR ESA outcome.....and I just starting doing a letter to the HB and I was mentioning the mixed age couple rules.....then I thought well that doesn't apply till about 1 months time so I can scrap that one
So what do I say, as I said Id rather a letter as they are not great to deal with ?
Is it a change of circumstances that he is not on Income Support and I'm on CB ESA but awaiting the results of the IR ESA dated from the date of his IS ending ?

Just tell them exactly what's happening and ask them if they can recalculate your award. They should know that his IS claim closed because DWP usually share information, although you should have also reported the changes anyway, which I think you did. Sorry too many pages to go through to check.1

I think I will write to them I think and explain I as best I can. On the phone it will not go well.
And ask them to recalculate the award, will we still be entitled even if its only CB ESA I am on at the moment until the esa3 is done ?

It is a change of circumstances because your HB needs to be recalculated but won't prompt a move to UC unless your HB claim has been closed.1
