I still think that Age UK are the best to be contacting for advice, but as you say the SPA is a fixed point and so a pension claim whatever else you decide to do.
Time flies in these situations and mid April will be here quickly.

Many thanks.....yes I think I will do the pension thing this week or early next week

Gather all the information with figures for the phone call to AgeUK and probably do it this week or next week as well.

Yes time flies and I know sometimes you have to get the timings right to get the best result

I just wish it was less complicated

    Appreciate your reply
  • This is a follow up from the scenario, I have found out his pension and applied for it.

I am having a phone call back from Ageuk this week as well. But can someone check these UC figures at all which I have done please?

This is just so I know a bit more until I get further advice . Thanks

    Both over 25
    Myself Contrib Based  ESA
and my partner will be on state pension . (currently Income Support and SDP also Housing Benefit)

Myself High care DLA and Low mobility

    Partner PIP standard on both

LHA is £241.64 per week (although our rent is more and we pay the extra on top of that)

This is what I have so far.

    Couple over 25    £578.82
    LCWRA                £390.06
    Housing                £966.56
    Carers Element    £185.86
SDP                      £405.00 (as if we move over to UC will be a month before and still get TP)

    TOTAL equals       £2526.23

    MINUS

    Contrib based ESA        £ 518

    State pension                £ 815.40

    Total                               £1333.40

    So        £2526.33
    Minus   £1333.40

EQUALS UC of £1192.90         (And pay the £966.56 to landlord)

And the Contrib based ESA paid separately
    Also the State Pension

Would that look correct to you think? Thanks a lot

Your figures are not correct. UC is a monthly benefit so when calculating the deduction of other benefits you times the weekly amount by 52 and then divide by 12. This is because there's more than 4 weeks in a month. Same applies to LHA figures.

Did ageUK give you those figures?

    To correct those figures.

    Couples £578.82
    LCWRA element £390.06
    housing element (£241.64/week)  1,047.10/month
SDP TP if LCWRA element is included £132.12 (single person SDP)
     Carers element £185.86
     £2,333.86/month

     Deductions
     CB ESA £561.16
     State pension £883.35
     Total amount deductions £1,444.51 - £2,333.86 = £889.35/month UC payable.

You did say there's a shortfall of rent but then say that you pay your LL £966.56/month? Can you please confirm this is your rent amount?

I think their rent is more than this. From the opening post:

sadly our rent is nearly £300 a week (april it will rise no doubt, the LHA does not cover all of it)

    Many thanks Poppy12345
I just had a go myself at first Im waiting for a phone call and was trying to see if I could understand it a bit more, before the call came this week

I was not aware that you had to do the calculation like times the weekly amount by 52 and then divide by 12, so thanks for that

Thanks for redoing my figures for me.

Our rent is at the moment  £276.92 a week and our maximum LHA is £ 241.64 a week so at the present I was just taking paying the difference between the two a week of £35.28 x 4 of £141.12 every 4 weeks since the increase. It will be going up again this year

When I put the rent in the UC calculations I was just doing 241.64 x 4  which equals 966.56 obviously this is wrong as I wasn't aware of the proper way to calculate it.

    Many thanks

Sorry I was not clearer I did not know it was calculated differently

  • If the general calculations are correct kindly from Poppy12345 then we would get £889.35/month UC payable.

We would have to pay our actual rent out of that which is £1107.68 every 4 weeks ( £276.92 x4 )

    So 1107.68 minus
          889.35

equals £218.33  about £54.58 a week we will have to find from our ESA/Pension

At present  (on current legacy/HB/ PRE pension age we are paying £141.12  the £ 35.28

And it will be going up again very soon.....not what I was hoping for to be honest

I am hoping as a mixed age couple Ageuk  will have some more ideas about we can maximise our situation before April

The LHA rates are also rising in April too, here are the rates if you haven't seen them. Hopefully that will help a bit.
