  • Hey Stoneman, i believe the last flight was on Sunday, as we were on it. It is bloody freezing, i agree. I tried calling MJ on xmas day and managed to get through on the number given on their website. Its free so just keep trying.The guy i spoke to coulldnt have been less interested and informative though.

    We have flights booked back to Belfast on 1st so im hoping we get back in time.

    Good luck with MJ, post if you hear anything or get any news.

    Hi - yes - my debit card is a Visa.

    I think someone else can probably tell you better, but I heard that Visa debit cards offer similar protection to a Visa credit card - in terms of claiming your money back....

    Although never tried it myself.

  • Hi - I don't want to be the bearer of bad news, but I'm pretty certain that debit card transactions are excluded from the protection offered via the Consumer Credit Act 1974, section 75 - which is the legisalation that makes the credit card company equally liable in law for the provision of the goods or services.

    The fact that Visa process the debits makes no difference, I'm afraid.

    I too have lost my family's booked flights for our summer holidays next year, Las Vegas and Los Angeles, with Maxjet. I'm just grateful that I used a credit card and so - with a bit of luck - should get my money back from the credit card company.

    There is a very good article about Section 75 of the CCA on the financial-ombudsman site:

    It is interesting to note that "the claim is not limited to the amount of the credit card transaction. Customers can claim for all losses caused by the breach of contract.......".
    I believe that this means that if you you purchased a business class ticket on Maxjet the Credit Card company will have to make up the difference for you to get another business class ticket on another airline.
    I had one-way tickets to LAX booked for £513 ea, I have re-booked on BA Club Class for £999ea (incredible price - the BA web-site quotes £4,000 !!!!). I have asked MorganStanley/Goldfish to pay for these.

    My friends have contacted egg and they have been advised to contact abta if maxjet was a member to claim their money back via them?? Does this sound right?

    Also, how can i find out if maxjet were members? Their website is useless now.

    Actually Visa Debit Cards offer a similar level of protection. I'll dig out something concrete as they will try and resist helping.

    Sam, I hope you're right, but I suspect not. Visa perform all sorts of money transactions including credit cards, debit cards, cashback, prepaid cards - it's not how the financial transaction took place that is relevant, it's the fact that the consumer was using credit that affords the protection under the act. This protection also covers hire purchase and other credit arrangements.

    Still, hope you are right and I am wrong!
