Personally,  i would email the template response to the LoC by coupon mad to DCB LEGAL,  using their info@ email address

No additions,  no subtractions, no changes,  no omissions, so not what you wrote above

LoC is Letter of Claim,  what you recently received  ( there are plenty of abbreviations in this topic   ),  explanations are in post 5 in the newbies sticky thread in announcements near the top of the forum

The template response is in the 2nd post in the newbies sticky thread in announcements near the top of the forum by coupon mad,  about 4 down from the top of the forum

I did not refer you to any page,  but its the top of page 1

ok so im using the template that starts with

    "Dear Sirs,
    Your ref: xxxxxxx
I am the registered keeper but I wasn't driving the car.  Kindly revert to NCP with the following:"?????

Is that correct? NOTE- have you seen what i have posted (at the beginning of this thread) BEFORE you replied?

do i also need to pursue the section below coupon mads post (at this stage) entitled "
So, where to start dealing with a claim? DON'T SCRAWL A 'DEFENCE' ON THE PAPERWORK. STOPHere is a guide to MCOL, how to acknowledge service ('AOS'):"??????

You aren't dealing with a claim yet, so just stick to the response to a letter of/before claim.

The OP did already send that appeal telling Smart all about who was driving.  Oh dear.

    I called Debt Recovery Plus
    Oh dear again.

You could have killed this in the first appeal if you'd come here first. This was such an easy win for the registered keeper. A one-liner email would have seen them cancel.

Don't compound these mistakes by paying!

      :o

Please stop engaging with them and read the NEWBIES thread 4th post.

You are NOT contacting either of them. Sadly the appeal was awful and made your position worse, so please stop ringing and responding.

Come back if Smart try a Small Claim.
Hang on (going back over this and reanalysing things). just calling Debt Recovery Plus,. or a PCN being delivered does NOT categorically mean I am the driver.

    and from keith's post "
I hope you haven't sent that appeal yet.
It clearly tells Smart who was driving." - No it DOESN'T clearly tell anyone who the driver was. for all anyone knows I am/am not acting on the drivers behalf (even without stating this specifically) so actually im not convinced any liability of being the driver was stated. just an for your information and interested to hear people's views...?
