  • I Have seen a few appeals. It seems it doesnt really matter too much what you say as long as you dont identify the driver, as they will reject anyway. I dont understand this stringing it out for 6 months thing. What happens then?

    I am the registered keeper of the above vehicle and am in receipt of the Penalty Notice you issued. The land in question is subject to byelaws and as such it is not relevant land for the purpose of schedule 4 of the Protection of Freedoms Act 2012. Therefore there can be no hirer/keeper liability. You will need to contact the driver, who I will not be naming and there is no legal requirement for me to do so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    If you prefer you can issue me the POPLA code which I can use to have this cancelled.

    Yes; anything will do the job to get a POPLA code as long as you don't tick 'I was the driver'.

    "I am persuaded by Mr Yamba that the evidential effect of establishing that the defendant was the relevant keeper, does not produce any inference, rebuttable or otherwise, that the defendant was driving on this particular occasion. Therefore, there is no material inference for the defendant to rebut. As there was nothing for him to rebut, it does not seem to me to be right to draw an adverse inference from his failure to engage in seeking to rebut it."

  • on the online appeal form it asks for your address, no biggy as they already have that but it also asks for phone number which i dont want to give. It doesnt let you continue unless you put in a properly formatted phone number which is very cheeky. I have made up one  which fits but looks obviously fake, i just hope no one has that as their number.
