I have drafted the following witness statement in preparation for my court hearing which i have used information from both @golfR12 and @Citizen-K as neither completely applied to your circumstances.

As no date has been set for a court hearing yet and i have not heard back from Coventry County Court regarding relocation to Bristol do you think I am able to request that a hearing not be held between 29/07 and 10/08 as i am not available during this period? or do i not have a say in what date is chosen?

Do you think I should also add examples of Excel v Smith Transcript and VCS v Edward transcript to my witness statement?

As per the letter received, i need to submit by 09/07. When do you think best to submit? ASAP or leave it until the last minute?



Sorry - i have had to upload a copy of my witness statement as screen shots because i didn’t have access to my laptop to be able to copy and paste it into the box. Im not full statement i have included full details of each exhibit but for efficiency i have only includes a screenshot of the start of each one here. I can upload the full thing if needs be.

URGENTLY:

Send a fresh, signed & dated (old style, not the new version with compulsory Mediation) DQ to Coventry court and cc in Bristol court too, as well as the C's solicitors, choosing Bristol as the court and stating your Bristol postal address.  

Cross out up to a week either side of those dates as unavailable.  NEVER stitch yourself up with exact dates of holiday, obviously...

In the body of the email remind all recipients of the reason why the case needs transferring to Bristol for the final hearing and say you await the Bristol Court's Hearing directions.

If that is a witness statement, your terminology should be "I" not "the defendant".  In your paragraph 3# you use "the defendant" twice.

Use the multiple judgments (Chan plus others) exhibit, instead of several.

Yes you can add those other two transcripts
if you think the NTK was non-POFA.

@Coupon-mad, sorry im not sure what you mean by NTK was non-POFA? can you explain?

also where do i find the multiple judgements exhibit? so just to confirm this will replace all the exhibits i am currently using in replacement for this one recommended?

i didn’t received a NTK so would that mean mine isn’t non compliant under Protection of Freedom Act? i only received a claim form and threatening letters requesting payment. I still don't know what the charge is for because it hasn’t been detailed in anything i have received so far.

sorry to keep asking, i'm just really nervous that i don't want to get this wrong at all. Do you think the examples i have used in my witness statement are ok? as i still don't understand what you mean by using the multi judgement exhibit. i don’t know what i am defending myself against so is point 9 of my statement enough? 

I also received an email direct from DCB Legal today in response to the email i copied them into to Coventry county council requesting a change of location. Am i right to ignore this?

I will send my statement Monday if you think all is ok with it.
