Yarmor - I tried, so frustrating not knowing why - it is bugging me now which makes me a tenacious little human. If nothing in journal by tomorrow lunchtime I will write what you and Spoonie Turtle have suggested, including all the points and writing to the point also stating the amount of times I have asked for MR.

Right - this is what I am intending to write on my journal - no response as yet from UC. Does this seem ok.

I am again, for the 4th time, requesting a Mandatory Reconsideration to be carried out of the decision not to include any transitional protection element.

As previously explained, please see previous messages, I believe I am entitled to a transitional element as my UC award is significantly lower than the amount I was receiving from Child Tax Credits.

I am also requesting the breakdown of how the transitional calculation resulted in no transitional element award.

I exercise my right to a Mandatory Reconsideration. Please forward my request to a decision maker ASAP.

Yamor - no response yet so I am considering the next steps:

As I cannot face the Jobcenter again - system overload - I have, I think, one of two options. Phone and get person to action my message or go directly to ‘make a complaint’.

If I went to ‘make a complaint’ do I, as a matter of courtesy, write on my journal that that is what I am going to do and give them a deadline? OR just go ahead and make a complaint.

Will the place I make a complaint to be able to access my journal (I hope so) or will I have to collate lots of information etc. I have screenshots of my journal to help keep my written evidence safe.

I am thinking that I need to put the next step into action on Monday - they will have had 2.5 working days to have responded to my latest (and 4th) request for a MR.

Does this seem a reasonable course of action?

    thank you

I would write another message on your journal to say that as you have still not received a response and confirmation that the MR Request has been forwarded to a Decision Maker, you will therefore be making a formal complaint.
I say to do this not in order to be courteous, but simply because it may jog them to deal with the request!
You can certainly also call them, and see what the person you speak to do can do. Remember to be firm with them that you want the MR sent to a Decision Maker, and not simply an explanation why (they think) you are wrong.

You do not need to take screenshots for the complaint. A simple timeline of what has happened, and details of the 'gatekeeping' barriers which have been put in your way is sufficient. They will have access to your account to check it all.

I would advise that you also contact your MP.

Yamor and rosewalk - I have written the message on my journal (I take screenshots in case suddenly my journal has a malfunction of any description) and will wait to see.
Rosewalk I will investigate my MP and how secure that is - we have safeguarding issues which also do not help. I will think about calling - takes a bit of prep.

    Thanks to both of you

Yamor - it is so scary they are not listening and it is horrible. Phoned UC and Barry answered at 10;37. I said that I have not had a response to my 4 times request for a MR. He looked at my journal and then said exactly what everyone else at Jobcenter and the response from Anna at Nottingham that everything is correct and dont need any looking at - he went on and on saying same thing but I kept asking and saying that both UC and CTC took my pension and contribution based ESA into account but UC gave me over £105 less a month. I then got put on hold. He came back and said it was correct so I said again about how UC and CTC paid me and then he said ‘the only thing I can do is advise you to wait for a reply on your journal and make sure all your to do and other items are up to date on your journal. Then he said goodbye.

    I am shaking.

edit.   ; i went to my to do bit and there was a prepare to meet your work coach from the day I first applied but I am in the no work requirements or look for work and do not have a work coach. I have filled it in with skip skip and taken a photo date stamped of my work status - I dont want to be sanctioned.

    Follow the DWP complaints process.

    https://www.gov.uk/government/organisations/department-for-work-pensions/about/complaints-procedure

Problem with phoning or sending journal messages asking for MR, is that this means someone would need to call you to discuss and collect any further evidence you wanted to provide.

If you register a complaint, a complaints resolution manager would be assigned and they have more time to call you to try to resolve or ensure the MR was correctly presented to Decision Makers.

The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.
