Managed migration payments very different

@Yamor - hello. I went into local Jobcenter as suggested by someone on the forum to ask why no one has replied to my request for a mandatory reconsideration has not been acknowledged. I spoke to an advisor and she looked up my details and basically said it is correct - i can explain it to you. She also said I was the first to come in with migrated UC. I said I wanted to have a mandatory reconsideration and she said there were no grounds as it was correct and she would explain it to me (I presented her with a paper copy of UC award and my tax credit award). I am autistic and under unknown situations stim and become confused with input so I have no chance of understanding or remembering anything unless it is written down clearly which I kept saying as I was trying to be respectful. Eventually she said she would message my case manager which she did there and then and she said the case manager would call me to which I said I cannot manage that and she messaged the case manager back who said they would reply on journal.
The impression was that I was wrong UC were right. Certainly no mandatory reconsideration. Spoke in Jobcenter approx 9.30am and no journal response yet. Have just put a message on the journal detailing that I went in and spoke to advisor who messaged case manager and that I am requesting a mandatory reconsideration.
I am now lost, tired and very confused. I don’t know what to do.1 -
This is terrible, and is an example of something known as "gatekeeping", which they are not allowed to do. It is your right to request a Mandatory Reconsideration, and she cannot refuse to put it through simply because she thinks the decision is correct!
I would just keep firm on your journal that you would like a Mandatory Reconsideration to be carried out, and if they continue to refuse to send your request to a Decision Maker, then make a formal complaint. ( https://makeacomplaint.dwp.gov.uk/ )
If they can explain to you the basis for their decision at the same time as putting the Mandatory Reconsideration request through, that would be great, but these two things are not dependant on each other.5 -
@Yamor. I got a reply on my journal. I do not know how to blank out information so I will type it word for word.
Hello (my name). Your universal credit entitlement is £1,073.80 however this amount is subject to deductions, you have disclosed you have another income £335.78 and your ESA is also being deducted from your payment which is why the payment is £176.85. Regards (her name).
this was sent from Nottingham service centre ( I am not near there at all)
No mention of my 2 mandatory reconsideration requests or any breakdown of how it got there eg transitional payment has not been applied due to x . Disclosed amount is my ill heath pension - tax credits took pension and ESA into account.
I am even more at a loss - no one in UC are listening or telling me why I have lost so much money when I was not supposed to. What so I do - it is so tiring.
thank you.0 -
I'm sorry they didn't listen to you and tried to fob you off.
What do you do? The decision you want explained is the decision not to award any transitional protection. The written reasons you want are how the transitional protection calculation was calculated.
Keep stating those. Hold onto those facts - and until you get the relevant explanation, don't give up. I know it's frustrating, and I understand how not feeling like you're being listened to can be especially frustrating. But that's what you do, just keep neutrally repeating your specific request until they respond to what you are asking, not what they think you're asking.1 -
I would write something like the following on your journal:
I have requested multiple times for a Mandatory Reconsideration to be carried out.
As previously explained, I believe I am entitled to a transitional element as my UC award is significantly lower than what I was receiving from tax credits.
Please forward my request to a Decision Maker ASAP.

I would add the specifics -Yamor said:I would write something like the following on your journal:

a Mandatory Reconsideration of the decision not to include any transitional element
Also requesting the breakdown of how the transitional calculation resulted in no transitional element (or whatever the better/more specific wording, according to the legislation)1 -
Yeah, no problem with adding all that.Spoonie_Turtle said:

The main thing is to request it gets sent to a Decision Maker.0 -
@Spoonie_Turtle - I have written on my journal in the manner you suggested and will wait and see what happens.
@Yamor - I saw your post after I had written - I will use your writing next, after a response or on Wednesday if they do not reply. I think they will just ignore it and continue to do so. I take screen shots of all that I write and they write on my journal in case it disappears. I print my payment statement (s).
One ironic thing is my gas boiler has stopped working so the not using the missing money on heating!1 -
Hello. no response to journal today. I have been looking at my tax credit award and I think I may have worked out where it has all gone horribly wrong - under the child element for children section it is as follows:
1 child element @ £3235.44
(then under Family elements)
Basic (one element) @ £549.00
Total Child Tax Credit elements = £3784.44
REDUCTION DUE TO YOUR INCOME = £0
amount for the period £3784.44
the capitals is where I think the mess is. I got this tax credit payment as well as my pension and contribution based ESA - nothing was taken off!
Am I on the right track do you think?0 -
No, this won't be the issue. You were supposed to get full tax credits, as your income from ESA and pension were not enough to reduce it.0
