    Maybe.

But don't sit and wait for a SAR reply.  You have a defence deadline to meet.

Search the forum for other QDR threads with defences written already.

How do I go about doing a SAR?
That's described in the second post of the NEWBIES thread.
I have already given you a link to the second post of the NEWBIES thread.

    But as @Coupon-mad has said...

  • Ok thanks, if you didn't drive and only have a third party account of not paying the fair how would you propose to edit the template? Is it best to deny knowledge or say something along the lines? My argument here isn't that I was in the wrong but the fine they are charging is excessive etc so I don't want to contradict in the 3rd point. I also appreciate I have left this late
  • You have not received any "fine". Please stop referring to the PCN as such. It is only a speculative invoice from an unregulated private parking company.

You state in the template defence that you are the RK but were not the driver. It is fully explained in the template itself what you need to edit and/or add.

The Template Defence explains how a person who wasn't driving should edit para 2 and write their facts para 3.

"My argument here isn't that I was in the wrong".

Quite.  And that's not what the Template Defence says, either.  You need to read it.

About half the defendants who use the Template Defence aren't the driver.  It works for both drivers and keepers.

  • I suppose my point may not have been as clear as I had hoped. It's filling in the detail in point three that I would benefit from some advice or pointing towards other threads with similar. Is it enough to deny all knowledge of the alleged event?

I was working the day of the event and can prove this through my work timetable.

I have looked at the newbie thread and read the specific guidance. It's more the level of detail required and what I need to state.

    Search the forum for

    defence denied driver
    or

    defence denied driving
    or maybe

    defence deny driver.

We had one just like it yesterday.

ALWAYS ALWAYS change a search to show NEWEST and not the useless default 'best results' which gives old stuff from more than ten years ago!

  • Thank you that was helpful. A lot are not in the same boat as me.

My simple recollection of the events:

The defendant was working on the day of the alleged event. The defendant can prove they were not at the suggested location at the time of the claim. The defendant is unaware of the details that led to the vehicle being present at that location.

That's as much as I can say with certainty. Will this suffice followed by the rest of the template?
