Yes that is surely a winning point if that bay is not managed by them. Are you sure? Their signs are at every bay...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yeah, there are signs for each bay but the first four are for the dental practice and in their WS they have highlighted the 4 spots that are managed under Ruxton I assume. I was also going to argue that in the CCTV footage they have since placed additional signage as why would they put more signage up unless they knew it wasn't clear in the first place.0

Keep that fatal error quiet and raise it at the hearing. Don't tip them off or they could correct the error. Looks fatal to their case...

I've drafted these arguments for the court day, would they be acceptable? I've tried my best to be concise.
· In Exhibit GS-1, the parking agreement is shown for Ruxton Estate Agent, you can also see in Exhibit GS-3 that they have highlighted the parking spots under the management of Ruxton, my vehicle was not occupying any of the spaces listed as under control of Ruxton hence the claim against me is invalid. My vehicle was briefly in the spot which had the dental practice sign, which is the 4th spot along when looking at the google map image provided not in any of the outlined spaces shown as Ruxton’s which is who the claimant is acting on behalf of. Also, you can clearly see in Exhibit GS-4 the sign behind my vehicle shown in the CCTV footage is not the yellow Ruxton sign as shown in my Exhibit 09.
This mistake is shown throughout all the exhibits presented by the claimant, so I ask Your Honor to throw out this illegitimate claim.
· The CCTV timestamps in Exhibit GS-4 show I was in the spot for under 5 minutes, which is well within a reasonable time frame to assess parking permissions especially when the signs are near impossible to read even when standing up close in Exhibit 07.
· The signage in Exhibit GS-2 do not exist at the car park during the time I was there. The sign showing Private Land, is nowhere to be seen as shown in my Exhibits 05-10, also you can see in my Exhibit 07 you can just about make out it says, “Dental Practice” not “Ruxton Estate Agents”. Another point is that it says “Premier Parking Enforcement LTD” under the logo at the top, but on my exhibit, it clearly says “Premier Parking Logistics” further showing the blatant lies by the Claimant, which is probably why they can’t produce any real-life images of the signage being erected at the said location.
· Further to this, when looking at the CCTV footage in Exhibit GS-4, they have since added further signage between the period of 02/08/2023 and 10/09/2023 as there was no signage behind my vehicle in the footage but there are multiple signs about 8 additional signs added as seen in my Exhibit 06 & 09, and why would so many additional signs be needed if the parking signage were clear as presented by the claimant for when this incident occurred.
· I’d also like to ask Your Honor for the costs occurred to me due to this illegitimate claim, as it has wasted mine and the courts time. I respectfully request reimbursement for incurred costs from lost wages for taking time off work, fuel expenses, and preparation time for this court proceeding.

Google court finder and you will easily find an email address for your hearing court.3 -

Like you so many people don't receive 1st and/or 2nd pcn but the £170 payment due and court claim letters often manage to drop through letter boxes. PPCs always claim discounted/full rate pcns were sent though they offer no evidence to prove this. A letter's issue date is not it's sending date nor does it prove the letter was sent.
Since PPCs CHOOSE NOT to provide evidence of their posting date and delivery we must continue to press gov to ensure they do. Please sign/share @jmccabe petition. Closes 22nd june 2024.
