Thank you, I've removed that now and I think it's good to go just changed a bit spelling and stuff from what I posted above. When would be best to submit the defence document?
No later than 4 pm on the deadline date as advised if you are going to email it (as advised).
  • Thank you.
  • Hello Everyone,

I wanted to express my gratitude once more for your assistance.

I've received the director's questionnaire and reviewed the guidance provided. Regarding section A1, I was contemplating whether it might be advisable to explore mediation before pursuing small claims court. My idea is to propose a settlement of £5-10 to resolve the matter. I'm not well-versed in this process, so please feel free to share your thoughts on whether this is a sensible approach.

    Nope.

The NEWBIES thread covers this stage and explains why not.

  • Thank you for your response. I think I may have misinterpreted the information provided.

If I understand correctly, it suggests that in this situation, there may be no room for negotiation or mediation regarding the payment amount. It seems to recommend that you decline mediation as it is conducted by a commercial company working on behalf of the courts, and their primary objective is to keep cases out of court, rather than assessing the merits of your case or considering a reduced payment.

In summary, it appears to indicate that the options are limited to either making a full payment or proceeding to court. Is that the correct interpretation?

Yes that's the correct interpretation of the opinion here, and of course you can probably work out which is the preferred option of your two alternatives.

  • In summary, it appears to indicate that the options are limited to either making a full payment or proceeding to court. Is that the correct interpretation?
Yes. However, "making full payment" should not be considered because even in the unlikely event you lost the case, you would pay less than the original claim amount as they have added illegal costs/damages that are not allowed in a County Court small claims track. The claimants only rely on those amounts if they can get a default judgment because a defendant hasn't defended the claim.

So, it is always better to "proceed" to court. Invariably, these claims that are defended using the robust template defence are either thrown out before reaching court, are discontinued or won at the hearing.
  • I appreciate your clear explanation. I'm ready to fill out the form now. Could you please confirm the submission method, whether it should be sent via postal mail or if email submission (where I sent the defense submission) is also an option? Additionally, should the copy to Gladstone be through email or postal mail?

For information, I received the directors questionnaire through the post.

Look again at that checklist you were following when you filed a Defence. It answers all the questions you have just asked.

You can either scan that one or, better still, just download one from the interweb.
