Probate - how long?

    In some circumstances they may ask this or not, (statement of truth) - is this really the witness who signed the will 5 years ago?

    Will search - costing £100 through solicitor should come back with zero results, just to confirm that the will I provided in the initial application is the only will and the last will and testament.

    so hopefully probate office won’t have any other questions and therefore should grant probate
  • We applied for probate in mid June (mum's uncomplicated estate no IHT due, she passed away in Apr). Last Sunday (3rd Sept) had an email from probate services saying more info needed - they were missing the IHT421. The IHT forms were sent to HMRC 31st May & we had a letter from them dated 23/06. I phoned HMRC on Monday (4th) and no, they hadn't sent the IHT421 to probate services & sent it whilst I was on the phone to them. I phoned Probate and they confirmed that they did now have the form but still haven't issued the Grant of Probate, I did ask how long now and the response "within 16 weeks".  Monday (11th) will be 12 weeks since we applied.
    It's really not good enough, I did my grandma's probate way back in 2002, paper form and estate was completely wrapped up within 3 months of her passing. 

    I take it you didn’t go through a solicitor? It should be done quicker than having a solicitor despite your hiccup with IHT forms. Since 2002 there has been a pandemic hence why there is a backlog of probates

    Yes, I did probate myself. I am aware that they've had these delays since 2020 but, even though they have taken on more staff, the delays aren't reducing. I know someone else who is in a similar situation, her mother passed away a few weeks before mine but their probate is being undertaken by a solicitor and it took longer for them to get to the point of applying than it took us. We are hopeful, and have everything crossed, that probate will be issued shortly. 
  • Does anyone know… when sending things back to probate registry (statement of truths and will search)… does my application go back into a queue and I am unable to chase them? Or will the registry just more or less look at my application and grant it?
  • My Dad passed away at the beginning of January this year, and I started the Probate process at the end of January, i used a solicitor to do all the heavy lifting, not a complicated case, only son, i am the executor and sole beneficiary, but had to have the RNRB applied as his estate went over the threshold.

    I was not that confident in doing it, i would rather have somebody do it correct, so it's done right, so i left it to the Solicitor, which took an age,we had to wait for 2 months to get a statement from NS&I about his Premium Bonds, so this set us back 2 months, not sure whether the Solicitor was at fault or NS&I, as when i chased up the delay with the Solicitor, the Statement arrived a week later!! (probably passed the job onto a junior, who forgot to speak to NS&I).

    Probate went in on the 12th July this year, and i received Probate on the 17th September.

    So about 8 weeks in total for me for me when probate was actually sent in, but around 8.5 months in total from start to finish.

    Straight forward will with no IHT to pay submitted in mid June......e mailed requesting more info but did not specify what info so e mailed them 3 times over last 8 days but nothing back.......bit of a joke really.....14 weeks in.
    If God didn't want us to eat animals, why did he make them out of meat. :beer::beer:
  • We're straightforward, no IHT, submitted end of June, nothing yet 🤷‍♀️
  • It was 5 week for us after paying for IHT and waiting two weeks before sending probate off. I think we go lucky

    I was not expecting Probate until the end of October and maybe into November, after being told by my solicitor it would be between 12-16 weeks, so to get it after 8 weeks I was shocked, he even rang me on  Sunday to tell me. he must have been shocked himself.

    Not sure using a Solicitor is quicker or not, but it was quick for me, keep checking on the probate search, as mine got granted 4 days before the solicitor told me.
