Civil Enforcement PCN advice please

Hi,

Hoping for some advice as I'm not sure what to do. I recieved a letter quite a long time ago from Civil Enforcement regarding an unpaid parking charge in 2019, at the time I looked into it and remembered that I did park there and I would have paid for it, however I can't remember for sure and I don't have any proof that I paid. The parking was for more than 12 hours. There's no way I would have risked not paying... I wrote them a letter asking for more information and proof, I didn't recieve a response. Worth noting that I believe they tried to contact me at my old address before I got the letter at my new address, I didn't change my address with the DVLA straight away after moving house.

Then recently on 18/07/23 they sent another letter "letter before action - claim for debt" about the same incident. The letter is very vague but basically says I need to pay or respond within 30 days. I appealed online, again asking for more information and proof and stating that I sent them a letter last time with no response, a few days later I recieved another letter basically saying they have no record of a payment and if the sum is not paid within 14 days, proceedings with be issued.

They are asking for £182. There is no way to contact them other than to re-appeal online which seems pointless as I don't have any proof (who keeps parking receiepts? let alone for 4 years?) Is it just my word against theirs? Should I pay now or just ignore it? Will they take me to court?

If you need anymore info let me know. Not sure what to do now?

    The first few paragraphs of the second post of the NEWBIES thread explain exactly how to react upon receipt of a Letter of Claim.

    You must make sure that Civil Enforcement Ltd have your correct current address to avoid a Court Claim being processed through the courts without you having an opportunity to defend yourself.

    Thanks, I've had a look, so it says I should send a SAR? I've looked on CE's privacy webpage and I can't find an email address to use, any idea?

    Reading the first post as well, is it worth doing a re-appeal with the template provided for "TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING:"

    They have my current address now

    The NEWBIES thread SAR section already tells you how to find any PPC's DPO email.

    Then you have a very real problem - nothing to do with parking.   ;)

    While your case is quiet ... we need evidence photos please!  From friends & family too.

    We sincerely hope that you are au fait with the need to respond to the private parking draft Impact Assessment by mid-September?

    The Government released a 'draft Impact Assessment' ten days ago and it has some useful analysis about the fake added £70 'extortion' that enhances claims.

    We need YOUR photo evidence please...but not of the car park in your claim.  Nope!

    You want to help us change the law?

    To be clear, we are nearly there; it's not a petition or some weak campaign, it's a final push on a law already passed, to cap the £PCN levels and ban the fake DRA fees.

    The Government has a Call for Evidence open right now.

    We are wanting photos of unmanaged car parks, Hospital car park signs near you that show £50 or £60 as the deterrent, and Aldi, Asda, Tesco or Sainsburys £70 signs please.

    We need photo evidence of low or no deterrent car parks near you, please!

    NOT £100, NOT £90 or £80.

    Just signs that are less - or places with no PPC.

    ok, while I don't have any evidence of that kind right now I'll keep an eye out for the future. Thanks!

    I have sent the SAR now and will update this post if there are any developments on my case.

    We have August/September to collect photos.

    DEADLINE IS NOW FIRST WEEK IN OCTOBER.

    Everyone has 'good' car parks near them with no PPC and everyone has a phone.

    My family alone have taken c200 photos this week to help change the law.

    Please do post any you see on walks or by car, where private land has no PPC infesting it or a supermarket or Hospital has a £PCN between £50 and £70.

    Hi, update, I have recieved a response to my SAR where they have provided all the requested information, the letters which were sent to my previous address which I never saw, photos of my car entering and exiting the car park (the exiting one is very unclear and doesn't show my number plate clearly), and a list of all payments made on the day and 2 days after.

    The thing is they seem to have proof of me being there and not paying, and since it was so long ago I can't even remember if I paid however like I said there's no way I would have left my car in a car park for almost 12 hours and risk not paying. I don't even remember the payment system of the car park, if it was pay and display or pay on exit etc.

    It has been more than 14 days since their last letter (31/07). What should I do now, continute to wait? Or just pay so I don't inccur further charges if I have to go to court etc?
