Completely misleading in a remote camera enforced car park because unbeknown to the driver they are held to an earlier time that they are not told.
But a consumer SHOULD reasonably be entitled to rely on the 'expiry' time on the receipt printed at the moment of the transaction being performed.

My main issue with these tickets is they mislead consumers about the expiry time, even though the P&D system is interrogated and compared to the data from the ANPR system.
Therefore, the two AI systems are capable of interacting (with no human intervention needed, no work involved) and we know that they can present drivers with their car arrival time.
e.g. this is what Horizon at Tesco shows you when you enter a parking 'code' (printed with your Tesco receipt) at home, to use the advertised offer to exempt your car later that day. It shows the arrival times, so it is indisputable that the system knows them in real time:
As I say, it is indisputable that they know those times IMMEDIATELY because if you use the kiosks in the car park when walking outside with your shopping you are presented with your arrival time, to the second.
Therefore, a P&D machine can do the same.
If not, a kiosk could do this for you on arrival and then present you with a way to pay for your planned stay, automatically calculated to show you that your 'parking period' starts from 5 or 10 minutes after the arrival time to factor in the applicable consideration period.
All of this is already done in the background but withheld from drivers.
This set up (in fact ALL P&D machine receipts printed on private land right now that show an expiry time) constitutes a 'misleading action' or 'misleading omission'.
This conduct breaches the DMCC Act 2025 and can now be reported to the Competition and Markets authority, who can FINE rogue traders.

We occasionally see "pay on exit through the app" cases where you have to guess when you entered the car park, which could be many hours prior. The ANPR timings are purposefully hidden from the app.1 -
LOTS to read and digest when arriving at Mercure Hotel, Pembury, Tunbridge Wells. A huge array of signage around the car park from Smart. I suspect PCNs are rife, as there are multiple signs stating reception cannot help with PCNs. The place is run by Jupiter Hotels/Interstate UK Management/Aimbridge Hospitality. They've clearly decided to aggresively monetise the car park and have either signed a very restrictive contract or don't care about repeat business and/or are on a cut of the PCNs..
DRA fees are mentioned only on bullet 4 of the tiny-font T&Cs sign and of course the amount isn't stated: "..may incur further costs..":
Smart's large poster that greets customers before they enter Reception is water/condensation-damaged, but is interesting that Smart refer to their invoices as "fines"!:
"If you fail to pay or register your vehicle correctly, the hotel cannot assist with fines or disputes.":(Oh, and still shows BPA. And despite that poster at the entrance referring to the "SMART Parking app", all the other signage only mentions RingGo):6 -

Total Car Parks, weird text about the recovery fee:"LATE PAYMENT: Failure to pay the parking ticket within 28 days from date of issue may result in the Registered Keeper details being requested from the DVLA and a payment of £150 forwarded to: DEBT RECOVERY AGENCY for collection or court enforcement. This will incur further administrative and legal fees that you will be liable for."
GSV shows the lack of entrance signage. The sign above is attached to the right hand corner of the building which was a pub when I lived in the area.

£30 by day 7 (but the PCN won't have arrived so that's a joke offer)
£60 between day 7 and 14
£100 between day 14 and day 28
£150 from day 29. By specifying it on the sign this makes the 'parking related charges' £150. Wakey wakey MHCLG. Added fees must be banned.
...yet the PPC has done literally NO EXTRA WORK WHATSOEVER during this time (and the Late Payment regs don't apply to consumer contracts, for good, consumer protection reasons). Therefore £30 increasing to £60 would be sufficient.
The industry make all this up and they seem to pull the wool over the MHCLG's eyes. It's embarrassing. For the love of God, this is a trader invoice not a penalty regime.
And this is the first year - ever - that this 'increase on day 29' has happened so quickly, yet the MHCLG has completely missed it under their watch. Didn't even ask in the Public Consultation about restoring the (2024-dropped) BPA reminder letters, nor the fact that postal PCNs on street allow a far fairer '21 days from service' discount period.
And despite the Code paying lip service to the FCA CONC rules, the Government shows zero understanding of the concept of the 'Consumer Duty' that the FCA require properly regulated firms to embrace.
In their haste to 'bend the knee' (so says the AA) to the parking industry in the Consultation the Government has not been alert to recent 'scam' changes that only came in with the self-serving Joint Code.
The MHCLG has ignored the fact that the BPA CoP had two mandatory reminders and cases could not escalate until the third month. It is shocking to see what this Government has let happen under their watch then quoted it as if it's normal.
