Receive UKPC Parking Charge

I have received (15 days since the date stated on the notice) a UKPC parking charge notice.  The dispute against me is that I was parked outside of the designated box.  The box I was (partially) occupying was positioned off to one side of a single space location where this location was surrounded by a concrete wall on one side and a concrete pillar on the other.  Due to this rare feature, I took the decision, rightly or wrongly, to park directly in the middle between these two fixed obstacles.  By doing so was keeping my vehicle away from potential damage which may have resulted by me navigating to one of these obstacles closer than was clearly necessary for this particular single designated space.  I would also not be interfering with any other parking spaces, and cause no inconvenience to any other parking facility patrons, or prevent the operator from collecting parking charges for any other space by choosing to park like this.  Basically I was not hurting anyone by parking 30 cm off to one side of the edge of the white box.

I have appealed this charge on these grounds using the UKPC online appeals form, but I'm now wondering what I can do if this appeal, and any other future appeals are rejected, meaning UKPC may want to take more drastic action to get money out of me against what I consider an unjust and unfair demand for money.

The parking space is located in Scotland where I was on holiday at the beginning of July.  I live in England.

    Next time - if you get more - don't appeal saying who was driving.  That was a silly mistake, given the parking space (abd alleged contract) was in Scotland where they don't yet have keeper liability. 

    This time, what do you need to know that is not already in the NEWBIES FAQS sticky thread at the top if this forum board?

    The template appeal is there, as is all the info you need about all stages including 'PLAN A' (which is not 'appeal').

    POPLA is covered there, not that it's worth trying in this case, so DON'T.

    And certainly don't PAY!

    Plan A is always first.

    I thought it was bad to ignore them though?  Why are there templates to reply to them if you shouldn’t?

    this is all utterly ridiculous.  If saw the photo they’ve taken, you’d see how ridiculous this all is.  Yes I was marginally outside the box, but the car was surrounded by concrete, not other spaces.  So I wasn’t interfering with anyone!

    You haven't breached Plan A. You screwed up Plan B. You can still action Plan A. Complain to the landowner and write to your MP. As for Plan C, appeal to POPLA but not likely to beuseful to you, weather the inevitable storm of debt collector letters and wait for Plan D, a court claim. If you follow all the advice and don't poop your pants at the scary but useless debt collector letters and then defend robustly using the template defence, they will discontinue.

    I'm sorry if you're finding my advice ridiculous. This is Scotland. They won't issue a claim there; in any case they cannot claim any costs for a claim below £300. They are not into chasing lost causes for the absolute prospect of making a loss!

    Does it make any difference considering my "appeal" response to them already sent before joining this forum to ask for advice:

    "To whom it may concern,
    I would like to advise that I have only just received this parking violation notice.
    Although the date on the notice is 8th July 2023, and is in reference to proposed violation on the date of 5th July 2023, I have not received this advice until the 23rd July 2023.
    This is the soonest I was even aware that there was a proposed violation and could not possibly have replied to this sooner than I am now.
    I am appealing this parking notice and refer to the photograph contained within my notice as evidence of my case.
    Whilst I understand and agree with the policing of public car parking facilities and the targeting of violators who are clearly causing an obstruction or preventing the use of a space other than that they have paid for in themselves, it is clear that in this case against me that I have not done this. My choice to park outwith the designated lines for this particular space has caused no obstruction, or inconvenience to anyone.
    Nor has my parking prevented anyone from using any space(s) adjacent to the space where I have parked my vehicle.
    As can be seen clearly in the photograph attached to this proposed violation, the vehicle is surrounded by building obstruction.
    On one side of the vehicle is a concrete wall.  Behind the vehicle is a concrete and steel barrier with no access or egress routes available through this.  On the other side of the vehicle there is a concrete pillar between the space occupied by myself, and the adjacent space. In my opinion, there is no good reason why the white parking space outline should not fall directly in the middle between the two obstructions on either side of where my vehicle is shown, rather than be pushed over to one side, forcing people to have to navigate closer to an obstruction than is necessary.
    Any sensible and practical person can see there is no need for this when only one available space occupies this position.  This is the basis for my appeal.  This is an unfair proposed violation."

    Please don't get angry with me.  I didn't think to ask for help before i "appealed".  I was in a bit of a state of panic and anger and dismay over receiving such a letter in the first place.  We're all only human.

    I ask, because as you can see, i've clearly disclosed that i am the owner and that i was the driver at the time.

    (starting to really wish i had come here first before responding to these crooks)
