    : to strive or vie in contest or rivalry or against difficulties : struggle.

    So they realise how difficult and the struggle you are in for just doing your already difficult job on their behalf.

    More stress to add to my day, another reply from the land owners below.

    Thank you for your email, which has been passed to me as .......... Regional Manager.

     

    Whilst I appreciate it is frustrating to have received a parking ticket, the parking company have been legitimately put in place to stop issues with non-residents parking at the development, which I am sure you can appreciate would be an issue due to the development’s proximity to the town centre.

     

    There are notices clearly displayed all across the development on lamp posts and walls to alert anyone driving that parking enforcement is in place on the development. Also, all residents are aware this is in place and have been given the appropriate residents and are able to obtain visitor permits.

     

    I am afraid that we are unable to arrange for the ticket to be cancelled & you will need to contact PCM directly to appeal the ticket. Should you not wish to contact them, then that is your decision.

     

    If you have any further queries, please do not hesitate to get in touch.

    Dear xxxxxx,

    I won't bother you again until PCM sue me.  Your company is clearly content to be called to court over this by me as a victim Defendant, and surprisingly your replies appear to suggest you are content to support a 'rogue trader' outed on Watchdog.

    On 2024 the new statutory Code of Practice, sweeping away rogue parking firms and false 'appeals' farces, will require you/your agents to cancel unfair PCNs for on call NHS staff (and for victim residents who have permits that may slip down) so hopefully I've opened your eyes to the current issue you have, even if you are not yet minded to part company with this notorious firm nor to wonder why you are letting the tail wag the dog.

    would / could jopson vs homeguard be of any use here?
    while you were not delivering a physical product, it could be said that you were delivering an essential service (product) to a resident on the estate.

    the reply from the management company also needs shooting down, remind them that area liable for the actions of the parking company, and throw in jopson vs homeguard

    Any letter giving you just 14 days is not a LBC - as is already explained in the NEWBIES thread second and fourth posts.

    I just can't believe a law firm would take on these cases. I will form a letter when I finish work tonight. Thank you for your help

    These cases are the bread and butter of certain 'legal' firms.  Have a look at their website.  Gladstones aren't involved in anything else because parking debt collection is such a lucrative rip-off.

    Hence why the Government is stepping in so robustly and has called it 'extorting money from motorists'.

    Did you not know that Gladstones was connected to the parking industry; the IPC Trade Body?

    They aren't a law firm like you see in your high street.

    That reply from the landowner looks suspiciously like is been drafted by the PPC , and I'm sure there have been similar replies posted here from other places.

    Either which way it needs stamping on, remind them that they are liable for the actions of the parking company, and look into the Jopson case when your reply.

    Dear Gladstone Solicitors Limited

    Following my letter received from you today I would like to make you aware of a few points. As you must know I was visiting a patient who forgot to issue me with a visitor parking permit.

    Consumer Rights Act and the CPUTRs 2008 (which the 'appeals' and 'fairness' aspects of the code relies upon) are in force as is the Equality Act 2010 which protects people (including my patient I was visiting) and their carers.

    Jopson vs homeguard legal case could also be considered
    while I was not delivering a physical product, it could be said that I was delivering an essential service (product) to a resident on the estate.

    Would my letter cover everything?been worried all day about this . Looked at the other threads and now unsure if this is the correct thing to write????? Sorry to ask for help
