Also in the N180 form there is a section called " D: Suitability for determination without a hearing" this isn't on the thread advice list on filing out this form.
Is it OK to select Yes for the court to determine the claim without a hearing?

"I am not content for the case to be heard 'on the papers' because that seems to disproportionately give an advantage to a legally represented party. I feel strongly after all these years of intimidating demands from this aggressive parking firm and their agents, that I need a voice at an attended hearing. I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions."

If you want to almost guarantee that you lose the claim, then you tick the option to have the case “heard on papers”. We presume that is not what you want.

Regarding the statement about having paid, without having to go back through the thread, is your dispute with the claimant involve having paid for parking but have received a PCN anyway.

After sending off the N180 I've been sent correspondence from the parking company saying that their solicitors are no longer taking the case and they are offering me an out of court amount to pay that they say is reduced but is still £190.

Normal for VCS or Excel.  Everyone ignores that.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi B789.  Thanks for comment on the papers - I have made sure to select NO on this option now.

My dispute isn't about me having paid the parking - that's why I was confused about the letter from them.
I am arguing that I was unable to pay due to a faulty machine.
Awaiting further correspondence from them now as I am ignoring their offer of an out of court settlement.

Hello all, latest update on my claim is that I've been sent Notice of Allocation to the Small Claims Track.
I have a court date and need to send copies of my defense to all parties.

Any advise for court day ?

    Thank you xx

    Isn't it telling you...
"Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than..."?

Those 'documents on which you intend to rely' are your Witness Statement and evidence.
Your Defence was filed weeks/months ago.

Of course the second post of the NEWBIES thread explains all.

No.  Advice for WS bundle is your stage and it is already in the NEWBIES thread.
