    Hello and welcome.

I now have a County Court Business Letter (Northampton) obviously my mums name but C/O my address. They don't have my Mums address, my question is can I just reply to the CCBC saying she doesn't live here?
    That would be foolish.
It appears to them that your mother lives at your address, which is fine.
To now deny that she lives there would be unwise.

What is the Issue Date on your mother's County Court Claim Form?

    25th May.

With a Claim Issue Date of 25th May, your mother has until Tuesday 13th June to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, your mother has until 4pm on Tuesday 27th June 2023 to file her Defence.
That's a little over two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
I have filed the Acknowledgement of service via email ccbc@justice.gov.uk  to CCBC as the moneyclaim website is down

Ok, so you sent an email. That's fine.
You've now sent a second email. That's also good.
But of course at the moment you have doubts about whether the process will work properly.

Why don't you now take a few moments to file an Acknowledgment of Service using the method I described earlier? Do that at anytime of the day or night.
That way you will have certainty within a matter of minutes.

I will try again. The moneyclaim website was down earlier

Yes - the link I provided earlier included that too.
Why not just follow that link?

I have now had confirmation email from CCBC basically saying..

"Thank you for your email, your response has now been processed.

You can file any of your forms via email for future reference"

So now I have to prepare defence. Although aren't I meant to see the claimants evidence first?

You are defending what it says in the PoC on the claim form. Those PoC will mention the PCN and you say you have already appealed that PCN so you know everything that they have. Don't do their job for them.

Go back and re-read the second post of the Newbies/FAQ thread and follow the instructions in there. If you think they have other "evidence" that they haven't shown you, SAR the PPC but don't delay doing your defence. You can use that info later for your WS.

    No.

The Template Defence and NEWBIES sticky threads both explain what happens when.
