County Court Business Centre Parking Ticket

Options
Hi all. My mother has a blue badge, parked in a disabled bay in a shopping car park, her blue badge fell off dashboard.(It actually did) I appealed on her behalf, the company is
MET PARKING SERVICES LTD. Obviously lost appeal, I put my address on the appeal so she didn't get all the letters, she's almost 80. I got the usual letters with my Mums name but C/O my address, also emails saying type this password in, but replied to none of them, not even clicked on the links to the emails. I now have a County Court Business Letter (Northampton) obviously my mums name but C/O my address. They don't have my Mums address, my question is can I just reply to the CCBC saying she doesn't live here? and if so what would they say? and can they get her details from the DVLA even though the this happened over a year ago?
Thanks and your help would be appreciated.

    That would be foolish.
It appears to them that your mother lives at your address, which is fine.
To now deny that she lives there would be unwise.

What is the Issue Date on your mother's County Court Claim Form?

Did you "appeal on her behalf" or did you just appeal using her name as if you were her?

Which legal firm is representing MET?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Doesn't matter.
The situation that you have presented to the parking company is that she does reside there - or at least, she is contactable via your address.

To now say something different will cause you, and her as the named Defendant, problems.

What is the Issue Date on your mother's County Court Claim Form?

    25th May.

With a Claim Issue Date of 25th May, your mother has until Tuesday 13th June to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, your mother has until 4pm on Tuesday 27th June 2023 to file her Defence.
That's a little over two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

But to be clear, this is easy to defend.

    Do not worry, @LeoBoy

We will help your mum do that (well you can do it, in her name).  She has a strong case and there is no risk as long as you do everything we tell you to do.

As she is elderly and disabled, you MAY be able to do this in your name (acting on her behalf due to her vulnerability and her inability to attend court) but I forget how one does this.  It's not automatic.
