Changing unused 'council owned' gate?

    I was thinking alone the lines of knocking on and saying something alone the lines of ‘we are buying next door and I was just wondering if you knew anything about the shared space in between the two houses’. 

    Also hoping that if we go over the weekend, we’ll catch glimpse of what they’re doing with the building stones and slabs they have.

    Indeed. But the worst case scenario is that they'd be asked to remove it.
    Yes, albeit a worst case of being the co-owner of a new gate you've paid for and now have no use for. (remembering this is a money saving forum)

    Have been racking my brain to work out the best way to approach it haha as definitely don’t want to give an impression that we are buying the house and being difficult right from the off.

    Indeed, not much point forking out for a gate to be installed if I’m likely to be asked to remove it. I think the compromise is going to be, as others have suggested, just making the land in between the two houses presentable and try to ignore the gate until we are able to request it be removed.

    I don't think it has been specified - does the house you are buying have ROW down there?  I think you said it was not on the land registry plan - is it in words anywhere on the deed - for your property or the neighbour?  Just because there looks like being a gate in the garden wall may not actually mean it comes with any rights.
    I’ve had a look at the title deed but it doesn’t actually say. It refers to another plan. I bought that plan from land registry (for a house further down the street) and that didn’t say anything either, so waiting for the solicitor to look into it.
