You are best placed to decide if you feel like you have a strong case. You've seen all of the above; you've seen their photos.
You heard what the first Judge thought at first glance. You've also won in court before.
If you want to know what I would do (VERY general advice, bearing in mind I know almost nothing about your case even though I just read back on this thread to look for clues to see if it's strong or not):
I would email DCB, remind them that:
- their rep asked for a 3 hour hearing, so those costs plus the first rep's costs for attending are already disproportionately high for a 2 PCN case, but they invited this expense;
- the first Judge said the defence looked impressive;
- the Particulars of Claim are wanting, and fall foul of CEL v Chan and other judgments which are all in evidence;
- they could have served better Particulars within 4 months of the claim, but did not;
- it was in their gift to properly plead the claim to comply with CPR 16 in the first place;
- they will end up spending more on this case than they could recover, even if they win;
- therefore, the following has value to their client: they are invited to drop hands, discontinue and both parties walk away without costs.

There are NO templates
There are half a dozen exemplar witness statements listed in post 2 in the newbies sticky thread in announcements at the top of the forum, posted by previously victims of these parking companies
You are welcome to base yours, in word, on whichever is best for you, so you don't need to start from scratch

Hi everyone,
I wanted to share my experience regarding my parking case, similar to this one.
I’ve been following this thread since September 2023, when I received a money claim from MET Parking through DBC Legal for two PCNs incurred seven years ago.
I used a similar defense and witness statement tailored to my situation, which involved an alleged overstay at BP Stansted and waiting near a “no waiting” sign. While I haven't seen the PCNs, the particulars of the claim were similar to the case discussed here.
I had my hearing today, and I’m pleased to report that I won. The judge ruled in my favor, ordering the claimant to pay me £95 for my loss of leave.
Interestingly, the judge rejected my argument that the particulars of claim (PoCs) were unclear, even though I felt they didn’t provide enough information for me to mount a proper defense. However, he concluded that MET was not claiming keeper liability but driver liability. Since the claimant couldn’t prove who was driving that day, he dismissed the claim.
This is my second successful defense against an unfair money claim, and I’m grateful to this community for the support.
