Great thank you.Coupon-mad said:Yes, in that case nothing more needs doing. Except always phone the court one or two days before, to check the hearing is still listed (that DCB haven't discontinued behind your back = common).0 -
Hi @Coupon-mad, I've not received any correspondence regarding a discontinuation. Hearing is scheduled in 2 weeks time. What exactly do I advise the courts in terms of me being unable to attend the hearing?
Many thanks0 -
Ring the court to ask if DCB have discontinued.
If not you will have to do what I said in another thread earlier, by @RocquéRecordsSadly it means you are more likely to lose, because you are giving their legal rep 3 hours to bend the ear of the Judge in their favour. That's domination by them. Half a day to spout their side.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Would it not have been advisable for me to have contacted the courts back in February when I received the new hearing date to advise that I would be away on the new date?? I was advised against doing this when I asked in this thread. Surely given the fact that I had a pre-booked holiday on the newly scheduled hearing date, the court would have had understood and rescheduled given that I had attended the original hearing??Coupon-mad said:Ring the court to ask if DCB have discontinued.

The claimed amount is £530 which I cannot afford at this present time already, and I'm guessing there will be costs added to this.0 -
I have just reviewed the thread you have referred to. It seems there was an oversight by the OP on that thread in terms of the date of his pre-booked holiday, whereas in my case as soon as I received the new date, I was aware I would be on holiday, however, I was strongly advised to wait until 2 weeks before the hearing to contact the court. Now being told I'm going to likely lose this case if not attending has caused me huge worry as the claimed amount is over £500 which I just cannot afford at the moment. It would have been much cheaper to postpone my holiday by a week back in February had I been told there was no other way around this other than attending.Coupon-mad said:Ring the court to ask if DCB have discontinued.

No, it isn't that easy. You would have had to file an application and paid £108 court fee to ask to change the date.GolfR12 said:

Ring the court on Tues morning to ask if DCB have discontinued. You could ask if you can attend remotely by video. They might be able to accommodate it.
If not, you will have to email and say a similar thing to the other person.

I would have paid the £108 fee to change the date if that was my only option but I was categorically told numerous times not to contact the court until 2 weeks prior. I did ask this a few times because I I was uncertain that waiting 2 weeks prior to the hearing would be the right thing to do, but I was told you know what you are doing. If I was told I would likely lose the case if I did not attend I could have postponed my holiday for a very small fee.Coupon-mad said:

No you could win. But not attending makes it much more in their favour unless they have discontinued.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Are you being able to confirm the reason I was categorically advised not to contact the courts until 2 weeks prior to the hearing date? Was this a mistake by yourself given the circumstances I had advised?Coupon-mad said:No you could win. And would this need to be paid as a lumpsum or could it be paid in installments?0 -
This is only a small sclaims court so no adding costs.GolfR12 said:

The claim shows the amount but that does not mean DCBL will get all of it if they won, judges tend to deduct the fake add on that DCBL claim for.
Also, most judges will will either dismiss the interest amount or reduce it
But HEY, why think about losing. This is just another UKPC rubbish claim with DCBL chancing their luck AGAIN ??
AND JUST SUPPOSE YOU DID LOSE
It will be the judge who will allow monthly payments1
