Got 2 tickets in less than 24 hours for parking in my own bay! :)

If it is your specific contracted space then perhaps you could take action against them for doing unauthorised business on your property. However, on the flipside, don't go to them if someone else has nabbed your space!1

Hi, I have been living at my address for almost 4 years and have an allocated parking space in a gated garage. My tenancy agreement doesn’t mention displaying a permit, but does state to park in correct space.
a couple months ago my permit fell off and I stuck it back on only for it to fall off a day later. I received 3 parking fines in that time from Parking and Property Management. Two were issued on the same day!I did appeal as registered keeper and was rejected on each one.
i have now received 3 letters from BW legal asking for payment and offering monthly payment plan for all 3. It states that if I don’t make payment by 18 September, the next letter from them would be letter of claim.
my question is if I do end up going to court, would I be going 3 separate times? Or once for all 3. This has caused me so much stress, but I refuse to pay almost £500 for parking in my own bloody space.
all advice is appreciated.
thanks0 -
One claim, one case to defend, as long as you reply to BW Legal robustly by email, quoting all three letter Refs and telling them to get lost or crack on with a single claim, not three.
NO PAYING.
NO PHONING.
Shocking scam innit?
Why on earth did the residents let this happen? Why do people move into places with a PPC? I'd never even look at a flat/property with a scum parking firm infesting the car park.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad thank you for your advice, will email them.
unfortunately, most flats in London have already been infested by these scumbags.1 -
What your lease/tenancy agreement doesn't say is just as important as what it does say.
Your property rental agreement has primacy of contract over anything an unregulated private parking company that is not a party to your rental agreement has to say.
You should be complaining vociferously to the landowner, managing agent, and your MP about this scam. Quote the wording from your lease in all complaints, and state you only displayed a permit as a courtesy, not as an acceptance of the parking companies contract terms.
Get together with other residents who have suffered the same fate and fight this scam.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks2 -
@Fruitcake thank you. I did write the MP a letter when I first received the PCN as well as property management but will write another one as both were unhelpful the first time.
would it not be too late as already been passed to BW Legal? Or is there a chance it could still be cancelled?
thank you1 -
Nothing is too late until a judge commences a court hearing.
Complain, complain again, and keep complaining that your rights are being trampled on, including your right to quiet enjoyment which should be included in your agreement as a standard clause.
Point out to whoever employed the PPC that they are jointly responsible for the actions of their agents and will therefore be required to attend court should a claim be issued to you.
Ask them to supply the contact details of the person who will be attending court to answer questions at the hearing.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks2 -
Thank for the advice @Fruitcake. Will definitely do that. Appreciate it.0
