    You have to send your WS to both the court and the claimant('s solicitor). If you haven't done it yet you could lose because you will have received something telling you to do this with a deadline that is normally not less than two weeks before the hearing. The claimant could ask the court for a judgment in their favour because you have failed to comply with a court order.

    Have you received the claimant's WS yet? Don't answer that until you have sent your WS to the claimant.

    No, have not received the Claimants WS 

    I sent my WS before the deadline to the court and they confirmed receipt of it.

    I have just received an email from the court saying  The case has been discontinued – please see the attached notice received from the claimant

    The hearing has been vacated

    On the N279 It was Ticked - discontinues all of this (claim) 

    I certify that I have served a copy of this notice on every other party to the proceedings 

    Signed by M Jones - Paralegal on 27th December 2023


    So it looks like that they backed out in the end. I will email my court to ask if I need to do anything further on this case.

    Why was this only sent to me today after sending the WS to the claimant today assuming the claimant completed the N279 on the 27th December 2023 and submitted it or did they submit it today to the court after seeing my WS?

    Anyway thank you everyone, I will keep you posted on this if I hear anything more. Thank you all

    Can I mention that at the end of Feb this year my partner has been diagnosed with a health matter and its taken a lot of my time and mental capacity. This court case claim arriving has just added to my stress. I am happy to provide "evidence" if required.
