Only submit your defence and draft court order during office hours. In other words, not until Tuesday morning, and make sure you get an auto confirmation response.I married my cousin. I had to...I don't have a sister.

Hi Everyone, hope that you are all keeping well.
Update... Letter received from DCB Legal
"Having reviewed the contend of your defence we are writing to inform you that our client intends to proceed with the claim.
The court will direct both parties to file directions questionnaires in due course. In anticipation of that we are enclosing a copy.
Without prejudice to the above.
If you wish to discuss settlement call on within 7 days and we will consider.
Sincerely

I will await for the court to send me the questionnaire, I am happy to go to court for this claim as mentioned. Its the same claim as the previous case that I won in Feb 2023. The fact that they are allowed to waste the courts time like this makes me angry for those with genuine cases.0 -
Keep up the good work. We are here ready to help if you need us again, but you have done something many of the regulars here including me have never done, and that is beat a PPC in court.
You could if you wish complain to UKPC and the BPA that this comes under cause of action estoppel which will be brought up at the hearing because it is an abuse of the court system to proceed with an identical case at the same location with identical particulars to the case(s) you have already won.I married my cousin. I had to...I don't have a sister.

Yes I will complain to UKPC and the BPA on an email and copy them both in of this case and the identical one that I won in court. Thank you very much1 -
Reply from BPA - What I expected from them.
Thank you for your email.
"I can confirm that UK Parking Control is a member of our Approved Operator Scheme which means that they are required to adhere to our Code of Practice.
Our role as an Accredited Trade Association is to investigate alleged breaches of our Code of Practice by members of our Approved Operator Scheme where evidence can be supplied.
We are not legally trained so cannot advise if they are acting unlawfully.
If you have not already done so, you may wish to submit your complaint to the operator using their internal complaints policy which can be found at: "
I will as mentioned take this case all the way just as I did the previous case. Its pointless dealing with the likes of bpa/complaints/ etc., best thing is go to court. Waiting for the questionnaire to arrive next....

No, you just send your evidence to the BPA. As it says:
"Our role as an Accredited Trade Association is to investigate alleged breaches of our Code of Practice by members of our Approved Operator Scheme where evidence can be supplied."
The BPA do investigate cases.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The BPA do investigate cases.Reply from BPA - They want me to "complain" to the scam artists, I do not want to dialogue with them. I will wait for court as its pointless trying to engage with UKPC as we know what the outcome will be
"Thank you for your response.
In the first instance, you will need to submit a complaint to UK Parking Control if you believe there has been a breach of the Code of Practice.
When an operator’s complaints process is exhausted and you believe the breach of the Code of Practice has not been addressed, you can escalate your complaint to the BPA.
Please note that in order to review your complaint, we will require a copy of the outcome of your complaint to the operator along with any other relevant evidence."
Thank you everyone and Coupon-mad for your reply

You now have to complain to the PPC first. Then to the BPA.
All AOS members have a complaints policy now.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Coupon-mad, but dialogue to PPC scam artists is something that I do not wish to engage in, I am only happy to forward my previous defence and WS which I won and make reference to this existing case (same particulars) I will not reply to them or have a back and fourth.Coupon-mad said:You now have to complain to the PPC first.
