The CCBC seem to be taking a couple of months to get DQs sent out.
    Nothing to worry about.
    Be patient.

Hi Everyone, I received the Notice of Proposed allocation to the small claims track Questionnaire on the 23rd August.

The deadline on the letter said by the 21st August I need to complete this

This letter was delayed in the post, the letter says 3rd August - The envelope the letter came from is evidence as its stamped 23rd August and has the CCBC Northampton blue stamp on it.

    Please advise

You'll be ok. Just complete it online and email it to the ccbcaq email address and CC in the claimant or their solicitor if they're using one. You can also CC in yourself as proof you sent it.

If you miss the deadline, they will usually remind you anyway and who knows how long that reminder could take.
  • Hi B789, I will complete right now and email it, thank you for the encouragement

    E2 - EXPERT EVIDENCE - NO

E5- NO - No vulnerabilities with the defendant

    Signed

Please confirm if correct and I shall email.

You didn't have to fill it out in pen and then scan or photo it. You could easily just download the form from:

    https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1079639/N180_Final_Form.pdf

Use a PDF editor to fill it in. For D1, you can use a text overlay, in 9pt Arial or similar, with the following:

I am not content for the case to be heard 'on the papers' because that seems to disproportionately give an advantage to a legally represented party. I feel strongly after all these years of intimidating demands from this aggressive parking firm and its agents, that I need a voice at an attended hearing.

I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.

Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.

Thanks B789 - I sent it via email from the link you sent. As I have missed the deadline should I write a separate email to CCBC and show the envelope that I only received the letter 4 days ago 4 weeks after the date of the letter was created that's why the deadline was missed?

    Thank you very much.

No, just keep an eye on your MCOL account status page and you will see when they update it as received, provided you have the auto-acknowledgement of your e-mail you should be OK.  CCBC (or CNBC) are some weeks behind in their admin.  If they did not receive your response by the 28 day deadline they always send it out again.
