Thank you Gr1pr, My son is bringing the Court Claim Forms round tomorrow evening. So I can read and get my head round it.
"You don't fill in any financial forms, not with a court claim" So We reply via MONEY CLAIM and not to reply to the 4 pages of the COURT CLAIM FORMS?
Best regards Kg0 -
Why are you not reading the guidance?
Or perhaps more to the point, Why is your son not answering the questions here?
I gave you a link to the second post of the NEWBIES thread.
Within the first half a dozen lines of that post there is clear guidance on how to deal with those forms.2 -
To be clear
Your son does not fill in the forms in the pack
Your son logs into MCOL and ONLY completes the AOS on there, nothing else, he then exits MCOL
He drafts his defence by adapting the defence template by coupon mad
When approved, he emails his defence pdf attachment to the CNBC in Northampton
You need him to understand the process, as a go between you could be complicating matters, good intentions but not comprehending the very important advice being given2 -

Thank you for the reply. I have used this forum to help out myself, stepson and brother ( he bottled it lol) and all succesful. So in january my son paid to park but parked in wrong bay. "dad can you help as you use the forum and have been succesful on winning! So Daddy helped not knowing it was going to be this involved. At this point I can not say Ive tried but Ive given up its all down to you now. I am retired and have a pc and tons of time so I am trying my best to help him. He works full time and long hours and no P.C.
Yes Ive read the "Second Post" and finally understanding the advise. My worry was do I fill in the form that was sent to us from "Claim Form" but that has been addressed "No, do not fill it in"
All the best and thank you guys.0 -

So draft his defence now, then post the proposed paragraphs 2 & 3 below, for critique and advice ( don't post the rest of the unchanged template. )3

struggling...
2. The facts in this defence come from the Defendant's own knowledge and honest belief. Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. The Defendant was in the Company van that was parked in the Parkhouse Court car park in Hatfield.
3. The Defendant was on his first and only visit to the location to meet up with a friend. The Defendant reversed his van into the bay. His friend prompted where the parking Ticket Machine was located and bought and displayed a parking ticket on the dashboard of the van. On his return to the vehicle, he noticed a PCN on the windscreen.
