    Redact the name and address, the QR code, the claim reference number, the VRM details and the MCOL password too , carefully checking all sections for those entries, especially after your previous redactions required more work

  • From dcblegal..... If its any different, he is the driver of his company van hence wrongly filling in his appeal as driver but who is to say who was actually using the firms van that day?

    We write in response to your correspondence received in our office dated 19/09/2024.

    We now respond to the same as follows.

    The terms and conditions on the signs stated that parking was permitted for vehicles clearly displaying a valid permit, or otherwise a parking charge notice would be issued. A valid permit was not on display as is demonstrated in the photographic evidence enclosed. The parking charge was issued correctly.

    The Original  Parking Charge Notice of £100.00 plus a recovery fee of £70.00 not including VAT. This fee has been incurred as it had been referred to DCBLegal.

    We acknowledge that you have said you was not the driver and do not believe our Client can hold the keeper liable. Please find enclosed your appeal which you have stated as being the driver of the vehicle..

    You now have 30 days from the date of this email to make payment of £170.00. Failure to make payment may result in a Claim being issued against you without any further reference.

    Payment can be made via bank transfer to our designated client account: -

    You have left the MCOL password visible.

    With a Claim Issue Date of 6th November, you have until Monday 25th November to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 9th December 2024 to file a Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Everywhere I have written 'you' or 'your' I do of course mean the named Defendant. 
    Everything must be done in the name of the named Defendant.

    You can easily do this yourself, you have editing privileges given the number of posts you've made and the length of time you have been active on MSE. 

    Simply click on the 3 dots at the top right of the particular post, click Edit, click on the image (which should highlight it), then hit the Delete button on your keyboard. Should disappear. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Hi Keith P,
    Thank you for your replies. This appeal is for my younger son, my brother bottled and paid up early this year.
    I have read the "second post in the NEWBIES thread but the dropbox link is "Money Claim Online?
    Do I have to fill in the  "Court Claim Form" first, in full ie earnings,water charges etc?
    I do find this "Squeaky Bum Time" and stressing me out!

    You don't fill in any financial forms, not with a court claim 

    You do not appeal a court claim 

    The person named on the claim form defends the claim, following the advice in the template defence thread and in the second post in the newbies sticky thread in announcements 

    If your son is the named defendant, they do the research and work. ( You can assist them but you cannot take over. )

    The defendant MUST follow the advice by KeithP above 

    PS , change the thread title to something like ,    UKPC Court claim
