I have used Citizen K's Witness statement and amended it as follows for a Motorway Services situation.

This is what I have amended to their template. The rest I have left in it including all the example cases.

    Facts and Sequence of events

    1. Date of the Incident: xxxxx

The defendant as the registered owner, cannot recall themselves or any other registered driver of the vehicle as being present at the Roadchef Killington Lakes. It is noted that the alleged parking transgression happened well over 5 years ago.

    1. Entrance sign: The signage as shown by Google Maps Streetview is shown at the entrance of the Motorway services. Coming off the motorway services at speed, with traffic and combined with poor visibility. How is a driver expected to read and comprehend such information? (See Exhibit 08).

    1. Poor weather, visibility: A cursory review of the meteorological data for the time and date shows that there was inclement weather (heavy rainfall and poor visibility at Killington Lakes and Penrith) as well as it being night time. Motorway services are supposed to be havens for motorists especially at night when tiredness is a major cause of accidents on the roads, coupled with poor visibility from heavy rainfall. To action this claim is setting a dangerous precedent for motorists that these services are not welcoming for drivers that are tired or not confident to drive in bad weather, which will contribute to deaths on the road. (See exhibits 05,06,07)

    1. Signage Changes: Furthermore, I would like to draw attention to the fact that subsequent to the alleged parking event, there have been signage changes at this location. Perhaps they haven’t quite got their signage right and in an easy to convey manner for tired or weary drivers looking for a rest stop? (See Exhibit 09)

  • I've used the generic exhibits from case law that is in Citizen K, so in total I have about 12 exhibits (Exhibits 5,6,7,8,9 are mine) the rest are ones that Citizen K had for things like Beavis case etc.

    So, good news! :)

I have not had any paperwork recently and decided to phone the Courts, the claim has been given an order of "Discontinuance" by the Claimant.

The court informed me that I can expect my paper confirmation for this to be no earlier than 40 days though.... :'(

    Hurrah!
