    Just send a fresh DQ now, and this time cross out those 4 months entirely, with an extra week added either side, to be safe. 

    State in your email that this replaces the previous DQ due to unavailability in Spring 2024 when you will be abroad.

    Hopefully it will be resolved by Spring 2024...?

    No way.  That's precisely when the hearing would be.  So attack that NOW.  You cannot put your life on hold.

    Got an email today saying

    To assist the Court in achieving its overriding objective, our Client may be prepared to settle this case. blah blah blah.... be agreeable to £XXXXX in full and final settlement of this blah blah blah....

    Although weirdly it seems to contradict the email I got the week before saying they intend to proceed.

    Anyways, I will keep the poker face

    Sorry for late reply, but is there not a hard time limit on the DQ being sent back? Its almost 2 months now since I had to send it. So if I send a new DQ today it could be accepted. Thanks

    Just send the fresh DQ to the local court and solicitor and explain in your email why you are updating your unavailability. 

    Put as the email title:

    URGENT - HEARING UNAVAILABILITY SPRING 2024 (hearing date not yet set).  CLAIM NUMBER XXXXXXXXX

    Add at least a week either side but don't point out that you've done that, of course!

  • Got a letter of "Notice of Proceedings" from the Civil National Business Centre with details of my local county court.

    Basically saying, please wait the Judge's directions

    District Judge X has considered statements of case and directions question......and allocated the claim to the small claims track.

    Unless the claimant does by 4pm on XYZ pay the courte the trial fee of £27 or file a properly completed application etc... the claim will be struck out on XX YY ZZ, .

    This hearing will take place on XXX YYY ZZZ

    This hearing is attended - In person


    ---- There is additional paperwork about mediation ----
