Court claim received

I have read through the guidance provided in this forum regarding defending against the court claim. I plan to acknowledge within the time frame and then create a defence letter using the template letter.

I am just wondering where and how I might share my draft letter once it's done for any adjustments suggested on the forum. Should I post on this new thread I have created?

    Yes, please post your draft defence here. We only need to see the parts of the template you have changed to suit your case, which is normally only paragraphs 2 and 3.

    Plan A of course is still a complaint to the landowner and your MP.

    Where did the alleged event occur? It may have cropped up here before.

    What is the name of the PPC and the legal company they are using?

    If it's tedious old UKPC and DCBLegal you can go adapt the defence by @Johny86 in half an hour flat. Just change paragraph 3.

    What's the DATE OF ISSUE top right of claim?

    Brief facts of incident:

    Went to play snooker at a snooker club
    The parking area outside the club is owned by the snooker club and other neighbouring businesses. The spot i parked in was owned by neighbouring business that issues PCNs. I didnt notice the signs
    I parked there for about 15 mins, it was night time so dark
    No ticket issued on site but letters sent in the post, never acknowledged by me

    My defence para 2 and 3

    2. It is admitted that the Defendant was the registered keeper and driver of the vehicle in question, but liability is denied.

    3. The Driver was visiting Penarth Road Snooker Club. The driver parked outside the snooker club in a parking space that was believed to be a parking space of the snooker club. The driver did not see any sign that indicated that the space was available to use. The driver parked in the parking space for approximately 15 minutes.


    There are difference in the defence letter of Johny86 and the template letter on the newbies thread. Which one should i use? and should i enter every para down to 27 and then statement of truth?

    Use the template defence to add your details in paragraphs 2 & 3 and then add paragraphs 4 to 11 from @Johny86, renumber the rest of the template defence.

    Is there anything else you will want to rely on later at WS stage? If so add those points to your defence if they are not already covered in the rest of the defence template.

    I already advised you to use his; yes it has an added section. That's the whole point of telling you to use his one (with para 3 adapted to suit your case) because, as you can see, there is an added section especially for DCBLegal woeful POCs.
