    You also need to check the formatting as you have a widow/orphan situation here: -

    "ERROR. (d) Believing the problem could be with their own device, the defendant restarted the device. and again attempted to pay using the Phone & Pay App. The word "ERROR: was still displaying.

    and

    which should be using commas as above.

  • Apologies for the delay in following up my last message.. I've been unable to create a jpeg etc of the letter in question.
    So, I will type out the main point of it here; just to see what you think of it. 

    THIS ORDER CONTAINS IMPORTANT INFORMATION ABOUT HOW YOUR CASE WILL BE DEALT WITH, PLEASE READ CAREFULLY.

    DEPUTY DISTRICT JUDGE HAYTHORNE HAS CONSIDERED THE STATEMENTS OF CASE AND DIRECTIONS QUESTIONAIRE FILED AND ALLOCATED THE CLAIM TO SMALL CLAIMS TRACK.

    UNLESS THE CLAIMANT DOES BY 2PM ON 18 DECEMBER 2023 PAY TO THE COURT THE TRIAL FEE  OF £27 OR FILE A PROPERLY COMPLETED  APPLICATION (i.e ONE WHICH PROVIDES ALL REQUIRED INFORMATION IN THE MANNER REQUESTED) FOR HELP WITH FEES, THEN THE CLAIM WILL BE STRUCK OUT WITH EFFECT FROM 18 DECEMBER WITHOUT FURTHER ORDER AND , UNLESS THE COURT ORDERS OTHERWISE, YOU WILL BE LIABLE FOR THE COSTS THE DEFENDANT HAS INCURRED.

    It then goes on to state it is an attended hearing with a date set for late next January.

    I think I was interpreting it , perhaps incorrectly, as though CEL were dragging their heels so to speak, and not providing what has been asked for.

    I honestly haven't seen anything like it so far on other threads.

    I see it as the Court laying down some rules.
    If the Claimant doesn't pay the hearing fee by the date specified the case will be struck out.
    That's all that bit of the Notice tells us.

    What about the rest of the notice?
    Nothing about a Witness Statement filing deadline or a hearing date?

    Yes it gives a hearing date of mid January 2024 .
    Witness statement to be sent in no later than 28 days before the hearing date .
