Hi once again. It's been quite a while since I last posted on this issue. That's simply been because there was nothing to report.
However - that changed this morning when I received a letter entitled
GENERAL FORM OF JUDGEMENT OR ORDER.
I have copied and pasted what it contains.
I'm not exactly sure what this means, but it sounds like CEL haven't provided much evidence.
**"On 21 August 2023 Deputy District Judge Haythorne considered the papers It was noted that the Particulars of Claim are not sufficiently detailed to enable the Defendant to properly defend the claim. In particular the Particulars of Claim do not detail the alleged breach of the terms and conditionsIT IS ORDERED THAT1 The Claimant most by 4pm on 8 September 2023 send to the Court and so the Defendant a fully particularised Particulars of Claim which sets out the basis of the claim, details of the relevant terms and conditions and fall details of the alleged breaches of those terms, and which otherwise complies with the Civil Procedure Rules Part 16.4.2 The Defendant has permission to amend the Defence. Any amended Defence must be sent to the Court andto the Claimant by pm on 22 September 2023,3. This matter shall be referred back to the District Judge on the first available date after 22 September 2023 for further directions.Dated 21 August 2023"**

That is good.
It simply means that a judge has looked at the Particulars of Claim on the Claim Form and decided that they are woefully inadequate.
The Claimant has been instructed to try again and once that has been done, the Defendant is given the opportunity to revise their Defence to address the more detailed Particulars.
Keep your eye on those dates and complain to the court if you haven't received the revised particulars by 4pm on 8th September - just two weeks away.3 -

The letter doesn't actually flesh out what the particulars of the claim, that have been deemed inadequate, are.
I tried to share a picture of the actual letter, but I appear to be struggling with permission.
However, the content of the letter is exactly as I copied and pasted in the earlier post.
In the top box, it also says IN THE COUNTY COURT AT CHESTERFIELD.
That's the one I chose.0 -

Claim for money relating to parking charge for breach of contract terms/conditions (tcs) for parking in private car park (cp) managed by claimant. Drivers may only park pursuant to tcs of use displayed in cpand agreed upon entry/parking. ANPR cameras or manual patrols monitor vehicles entering/exiting the cp and tc breaches.
