Hi there,
iv received a county court claim form from a private parking operator for around £1.5k relating to 5 or 6 tickets from 2017. My address is in England however the tickets are from Scotland (my three kids shared the car).
iv received a county court claim form from a private parking operator for around £1.5k relating to 5 or 6 tickets from 2017. My address is in England however the tickets are from Scotland (my three kids shared the car).
The tickets are from a residential car park beside a block of apartments (which they didn't live in). Iv found the template defence which I will use but wanted to check if the fact I live in England is useful to use as well. Does the law differ?
Additionally, I received the claim letter is dated 9th January however I was in Belfast for a funeral for 14 days so I have only just received on my return last night.

Any advice would be hugely appreciated as a little panicked

When exactly did you file the AOS?Have you read the Newbies thread? Follow that with the Template Defence Thread.From these you will find out that you must do a SAR asap and hopefully learn about keeper liabilty.

As well as the date you filed an Acknowledgment of Service, please tell us the Issue Date on your County Court Claim Form.0

I filed the AoB last night at 8pm - immediately after getting in the door and opening the letter.
The issue date is 09 Jan 2023. Will they take evidence of my ferry tickets for the rationale for why I did not respond in the 14 days? I literally had no idea about it until I got home and opened the letter.
The letter and claim is also addressed to my Maiden name, if that makes any difference.
Parking company = UK Parking Control Limited
Solicitor = DCB Legal Ltd
I have submitted a SAR to UKPC as well after reading another thread however this was also last night.0 -

Do your defence today and include the fact that the land is not 'relevant land' under the POFA 2012 (therefore the Particulars of Claim are incorrect in contending that the Defendant can be held liable at as keeper or driver, because neither is possible). State that you were not the driver in any occasion because your adult children used this car when they were living in Scotland (if I'm right that they were living in Scotland).
Get it in within an hour or two now, by email. Make sure you get an acknowledgement email back.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Had a look on Google Maps and there is absolutely no clear signage at entrance. How hard should I put this in the defence?
It wont let me send G Maps link but if you search 24 Morrison Crescent Edinburgh - It is the small resi car park here.
(the tickets are from 2017 & that maps image is 2020)
