I'm a lady but many posters call us all 'mate'!

There is no "BPA stage". The BPA aren't involved as such.

There is only one template appeal in blue writing.   The keeper just needs to copy & paste it into Horizon's appeals webpage within 28 days of each PCN (for the new ones).  NOT THE DRIVER.

Re any that have already been appealed by the driver and said things like 'I wont drive on the land again' then yes, you have admitted to driving and cannot use the POFA 2012 winning POPLA appeal citing 'no keeper liability' because presumably they are already pursuing you (the driver).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay not BPA - but the POPLA appeal stage then, again, I’m new to this.

The blue writing appeal won’t work because I have overtaken the NTK’s as we transferred the liability from the actual Owner of the vehicle to myself, the insured driver / hirer of the vehicle.

so now that I have been dealing with them myself since I’m in a HP contract with the RK of the vehicle I can’t use and of the NEWBIES templates?

and we done the transfer after 28-56 days.

So what steps can one actually take to appeal these, nothing ?

And so if I can use the POFA due to that, what else would stand up to be sufficient enough to beat these because it’s over £3,500 in what has been racked up & I’m sorry but that is unheard of in A) a unclear area where there is NO signage and also somewhere that you don’t receive a physical ticket yet do in the post, near on 14+ days after having parked there.

Not to mention the RK of the vehicle isn’t at that address so I wasn’t notified until 30+ days that these had all been tallied up.

But the blue template appeal isn't meant to work.*

For an admitted driver like you it's a stepping stone to POPLA.  Or just adapt it, edit it or appeal in your own words, given they already know you were driving.  You are unlikely to win at POPLA.

*Would have worked if the keeper had appealed.

Is there any way that outlining the lack of signage & the fact that I actually work on the site that these tickets were issued & emailing BPA directly would potentially cause these to be lifted?

because the adequate signing is seriously beyond a joke, a legitimate reason as to not have known it was private land, also the markings of the bays have been rubbed out + I was parking overnight.

Do you feel like I could raise this to someone higher Perhaps an MP or directly to the British Parking Association explaining the situation and they could get it cancelled?

Inadequate signs can win at POPLA, yes.  You will need lots of good photos in the dark (NOT TWILIGHT).

Have a look at the current POPLA thread by StubbornGoat here and adapt it:

Only the landowner could cancel it.  Or POPLA if your photo evidence nails it.

You’re a star, just read the whole thread.

Seems like another unjust situation! I look forward to seeing your input on their POPLA appeal case & will adjust accordingly!

    Thank you.
  • Does anyone have a successful POPLA appeal with Horizon showing the legal requirement for the size of the signs?

if they do please link it

i have until tonight to submit for my appeal with them ( I will be able to take pictures of it with a tape measure against it too )

horizon in their appeal had massive and up close pictures of the ‘signs’.. as expected so I need to take a picture of where my car was parked + with the sign size and tiny writing

whoever appeals on their side is so clearly a cunning person with terrible grammar trying to win this appeal it’s hilarious.

I did find a successful one but have lost it and need it asap please if anyone can link me <3

POPLA Codes last 33 days, not 28.

There is no legal requirement for signage on private land, but there is Annex A of the BPA CoP.

Are you appealing on 'no keeper liability' (a slam dunk win for the registered keeper, cannot lose) or has the driver already been named in an earlier appeal and thrown that point under the bus?
