PCN Final Notice Letter

Hi guys much help needed, I tried looking through the newbie stuff but feel like an information overload (so don't bite my head off)!

The situation is a friend who is the keeper and driver received a Final Notification Letter for over staying time it states "longer than the maximum period allowed" doesn't state the period in the letter but does in the car park (owned by sainsbury's). They received the Final Notification Letter 1 month 1 week after the date of issue outlined on the letter. They over stayed by 40 minutes. I've found the blue template letter from the newbies page, I'm guessing this is what I should appeal with first.

Please advise on whether this is the correct procedure?

    Which PPC?

Why did they overstay? Disabled driver/passenger?  Was it a free shopping car park or they overstayed in a pay & display site?

Plan A in the NEWBIES thread is not appeal.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It was a free for 2hrs at sainasburys car park the company and they stayed more than the 2hrs I believe they were shopping or had been shopping in sainsbury's but will confirm with them. If by ppc you mean the operating company it's euro car parks. I'm referring to the letter titled: TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING: Located here: https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyou I don't know if this is plan A?

    please advise.

That is correct if you/your friend is the registered keeper; if it is a lease car then use one of the appeals written by @Edna_Basher after Plan A, which is complain to Sainsburys
  • So are you saying to make a complaint to sainsbury's but from what I've read here you should also appeal it simultaneously, also sorry to be a pain but is there a template for a complaint letter to sainsbury's you can provide a link for? and should a complaint only be made if a purchase was made at sainbury's?

This is not new advice.  Everyone is patiently pointing out what the NEWBIES thread already tells you is Plan A.  It does not say to appeal at the same time.

It is clearly 'PLAN A first'.

    THEN Plan B, appeal.

No need for a template for a complaint.  How ineffective in the long run, would that be do you think?  We think it'a an awful idea to use a template to complain! We do not provide one, for very good reason.

Did you miss the entire years-long thread linked early in the NEWBIES thread to all the SUCCESSFUL COMPLAINTS ABOUT PPCS?  Hundreds of successful examples there.  How much more of a steer do people need to do the easy cancellation route first?

Not the biased self-serving 'appeal' farce.

  • No it doesn't clearly say Plan A first there is no mention of plans which is why I'm confused by what your saying plus all the weird acronyms everywhere with no explanation to what they all mean, it is not user friendly I already said I looked there already and was confused by it, and to be patient with me! Please don't have a go at someone who's trying their best to understand everything in the forum. You mention complants about ppcs but I have no idea what this is so how am I meant to search for it, if I don't know what it is. Just having a go at new people for no reason isn't helpful.
  • I'm also confused by this Coupon-mad said:

I'm confused by what your saying because on another persons post, the person ignored it but then people told her she shouldn't have ignored it, so do I ignore or not? It seems some are suggesting you appeal and complain simultaneously, but this goes against your advice to just complain and ignore. referring to this post here: https://forums.moneysavingexpert.com/discussion/4742159/please-help-beginning-to-panic-now 3rd comment in the list seems to suggest not to ignore. I've looked at several other cases from sainsbury's too and none seem to fit the same scenario I'm in, so maybe ask questions first before you start shooting.

My advice was NOT to 'complain and ignore'. Did I say don't appeal at all?  No. Do I say "don't appeal" in the NEWBIES thread?  No.

Does my signature below every post I make tell people to ignore?  No.

"plus all the weird acronyms everywhere with no explanation to what they all mean,"

    No explanation?

It's in the resource thread, where you'd expect it to be. You've missed the 'forum acronyms explained' section in post 5 of the NEWBIES thread...

No it doesn't clearly say Plan A first there is no mention of plans which is why I'm confused by what your saying
I think you need to look again...

Straight underneath the first Q&A, as the very first advice, the NEWBIES thread says the following:
Action to be taken if you are the registered keeper of the vehicle, in this order:

    1. ALL CASES, EVERYWHERE - COMPLAIN FIRST, ESPECIALLY OVER A RETAIL, HOTEL, OR HOSPITAL CAR PARK:

Always complain to the Retailer very quickly. This is 'Plan A' :

Successful complaints about private parking tickets - how to get them cancelled! <<< CLICK

It can be easy and quick to get these cancelled by a landowner. If the charge was at a Hospital then immediately complain to PALS (Google it and find their local contact).

    2. ONLY after exhausting the complaints option, then as Plan B, the keeper appeals.

I see a clear numbered pathway and underlined 'in this order' then I explain 'Plan A' (especially for retail park cases!) and ONLY SECONDARY then I tell you about 'Plan B' clearly set out.

I even highlight PLAN A then PLAN B in bold.  How can I make that clearer, please?

Did you read all of the posts on the NEWBIE sticky?  The fifth post explains all the acronyms but even if it didn't, Auntie Google is quite good with that stuff!
Did you see this bit: -

We tell everyone to ignore debt collector letters but NOT to ignore PCNs nor letter before/of claim nor N1 claim forms from CCBC.

    It is very simple, really.

    1. Go to the Sainsbury store, seek out the manager and tell him/her that you would like them to cancel the PCN because you are a loyal customer and if they don't, you will take your custom elsewhere. You can also send an email to the CEO with the same request. This is what's known as Plan A.

    2. If you have no success with Plan A, you then follow the advice in the Newbies thread and appeal using the blue template text.

Preparation is key to succeeding in getting these PCNs cancelled or overturned. The Newbies thread explains in great detail what the steps are and how you should proceed.

Yes, it can seem overwhelming at first but perseverance and a bit of mental "elbow grease" is what you need to apply. No one here is going to do it all for you.
