I know I need to do the AOS, but with regards to the defence, we really do not know what we are defending as we have no details of the PCN.

Should we contact the claimant to get the evidence they have?
Why not just search the forum for  2017 parking claim and copy the style of another defence from 2021 or 2022 exactly like yours?

There are hundreds like yours, already done.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have searched 2017 parking claim and cannot see any posts with a defence relating to my case.

We have had nothing sent through until today, no chase-up letters or anything.

  • I assume this is a DCBL claim for UKPC ?

    Yes it is!
Sadly for DCBL they have taken on yet another rubbish case from UKPC

DCBL are faking the scam amount of £60.  DCBL are using contract law but the problem they have for a 2017 ticket is that no UKPC sign says that DAMAGES would be added. This is a DCBL fabrication in a feeble attempt to extort money from you.  In simple words, it's a lie

Telling a lie to a court is a very serious offence and is classed as contempt

So now you follow the advice given here, a defence, a WS and strict proof from DCBL that any sign from UKPC in 2017 clearly states that there is a £60 charge for damages .... there is not one.

It's going to be a pain but do what you are told to the letter.

There are only two options for DCBL
1: BE SPANKED BY A JUDGE ... the courts do not like fakery
2: DISCONTINUE as we see here

DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS

I gave you that information on your thread back on 11 January at 9:02PM.
    Where I wrote...
...you have until 4pm on Tuesday 31st January 2023 to file your Defence.

Since 4pm on Tuesday 31st January 2023 the Claimant has been free to seek a Default Judgment against you.

If they seek and get that Judgment before you have filed a Defence, then they win the race - it's game over - you lose.

Check your MCOL Claim History to see if there is a Judgment against you.
If there is, then you can ignore the rest of this post.

On the other hand if you file a Defence before the Claimant actually seeks and gets that Default Judgment, then you win this heat and go through to the next round and I suggest you aim to file a Defence before 8am tomorrow.

The good news is that whatever the Claimant may do, nothing untoward will happen overnight.

To create a Defence, and then file a Defence by email, look again at my 11 January at 9:02PM post.
