Hi all

My girlfriend just got this in the post today, issue date was 29/12/22 and they are chasing a PCN from 2017!

She does not remember getting a PCN and this is the first she has heard of it.
It mentions she agreed to pay but she does not know what they are taking about.

We have been at our new address coming up for 4 years now but she never received any letters at the old address.

Can someone please advise how to fight this as surely it cannot be enforceable as it is so old?

Thanks

Sam

You have left the MCOL password clearly visible in that image.

Also, the PCN number shown can be used by the parking company to identify the parking event.

Probably not a good idea to Acknowledge Service of a statute barred claim, but I'll leave it to others to confirm that.

Going by your previous threads/discussions you've endured a number of Parking events. Unlucky!

Sorry @Keithp but am I wrong in thinking it does not get statute barred until June?

The pen is mightier than the sword ..... and I have many pens.

Yes, you are right. When are they going to introduce hands with six fingers on them?   :)

...issue date was 29/12/22 and they are chasing a PCN from 2017!

With a Claim Issue Date of 29th December, you have until Tuesday 17th January to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 31st January 2023 to file your Defence.
That's nearly three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

Of course everywhere I have written 'you' or 'your' I mean the named Defendant.

I have now edited the image, thanks.

I assume this is a DCBL claim for UKPC ?
  • I know I need to do the AOS, but with regards to the defence, we really do not know what we are defending as we have no details of the PCN.

Should we contact the claimant to get the evidence they have?

    Yes it is!
