To show, should it get to a court case, that you have followed the PPCs procedures in an attempt to resolve the issue. Judges are not too keen on those who ignore everything, causing the PPC to have to bring it to court fir resolution.goonergaz70 said:Coupon-mad said:But don't expect the appeal to work. That's not why you are sending a dispute, it is purely done do as not to ignore it entirely.
Come back if you get a court claim. No panicking about CCJs (doesn't happen as long as you follow all our advice) and no paying UKPC for a quiet life...please..,
I'm perplexed, if I'm not expecting the appeal to work why am I bothering? Excuse my ignoranceBut it's a simple copy and paste of the initial appeal template from the NEWBIES FAQ Announcement, first post. Just simply go through the phases. Unless you can obtain a landowner cancellation, nothing is going to get the charge cancelled, especially by ignoring it.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Another point this will not be a council owned car park they are not allowed to use use ANPR you should never assume anything with parking it's what gets people in this position in the first place.

I did explain why a dispute is done 'so as not to ignore it entirely' then I pointed out that court is where these cases are resolved (if the PPC try).Coupon-mad said:But don't expect the appeal to work. There is no point trying POPLA.

What you don't do is sponsor the scam by paying due to being scared of an unlikely court claim.
I posted the above because I knew from the way you were replying that you thought the appeal was meant to 'work' and that you'd come back later this month telling us it had 'failed'. Nope.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yeah thanks, the devil is in the detail...now after the next few posts and going back and re-reading it makes total sense.
I appeal (to them) using the blue template, it'd not about winning it's about going through the correct process so if they take me to court (it might not happen?) I have a better chance of winning.
Sometimes I can be a bit slow, but hopefully I'm now getting there

That's exactly it!UKPC are litigious but when a case is well defended they are routinely seen to discontinue and the scam is over.
It's a long game but quite fun /empowering for you and it wastes their time & money.
The likes of UKPC have been banned twice by the DVLA for extreme rogue practice and are ex-clampers, so they are considered just time-waster bullies, not worthy of anyone's money.
Not some sort if authority or power to be scared of. Play the game. IGNORE DEBT RECOVERY LETTERS.
If you move house within 6 years you MUST tell them by email to rectify your address. That is the only CCJ risk (court claim going undefended to an old address). Everything else is fine.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So I revisited the car park - what a really crappy set of signage! lol
So when you enter the car park there is this sign, which is positioned perfectly so I actually CANNOT SEE IT due to it's position in relation to my car (part between the windscreen and door) blocking it to perfection...it's like it was designed to catch me out!
Then the signs in the car park that you can actually see don't make it clear what the terms are, simply stating 'no unauthorised parking' with minimal extremely small print details of what the terms are;

So I finally had my response to the appeal the other day, they are obviously not dropping the charge and they want me to confirm the drivers name and address by Wednesday...they go on to say how clear the signage is lol.
Anyway, what do I do now? Do I provide that information? Do I appeal again!? Do I just wait for them to send the POPLA number they will send me eventually?
Thanks in advance

You are not obliged to name the driver, so no don't reply.
Just sit back and wait.2 -
Obviously you ignore it. You want a POPLA Code.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
