KXL88 said:I got a response from IAS that prima facie case received. Email mentions if I would like to include any additional info. Have till 9th Jan to do so.Yes, number 5, which is almost word for word in Jopson v Homeguard one.
So you just wait, given you did respond.
Your lease is unequivocal isn't it?
You have a right that no PPC can interfere with. I hope you have not accepted any 'permit' scheme because that tries to undermine your lease rights.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Dear all,Just wanted to give you and update. Actually I've been waiting for an email from the IAS for such a long time, nothing came I decide I would login to see what's happening, turns out.....Appeal allowed at the IAS stage (this is rare right?) ! so I won!Thank goodness for the dashcam to prove 'insufficient notice.'Thank you everyone (especially the regulars!) for your help to get me through this. Also can I post the full things of what I wrote here (for my appeal + additional notes) or I should not? Here's what they said anyway....The adjudicator made their decision on 24/01/2023 07:30:36.
The Operator states the charge is issued for parking in the restricted area. The Appellant claims there is insufficient notice of this. They have provided evidence of the same. Further, no sign can be seen in the background of the Operator's images of the vehicle. The one sign that is captured by the Operator, is taken a minute after the last image of the vehicle.
There is nothing to show the signs were proximate to the vehicle or to undermine the evidence from the Appellant. I am satisfied it is more likely than not there was insufficient notice. Therefore, the appeal is allowed and I have not considered the other points.

Great result, in reality against all odds. Well done.Maybe the IAS are trying to hoodwink the Govt into thinking they have respectability and impartiality ahead of the selection of the single appeals service taking the new Code of Practice forward. They did the same at the time the IPC was trying to acquire ATA status with the DVLA.Leopards never change their spots! We know what goes! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well done! VERY RARE!
IMHO the IAS has such an appalling reputation that every interested MP knows about them and in my view, the IAS wouldn't have a hope in Hell of being appointed to ruin* the Single Appeals Service.
I will eat my hat if they do.
*(and that's not a typo)...
POPLA would have more chance IMHO but we don't even know if the service will be put out to tender. It might not. I hope it isn't.
Have to wait and see but IMHO there is surely zero chance of old Bryn getting a look in, not with their previous Annual Reports not only exposing the woeful (average 5% successful) decisions statistics but also in 2021 slagging off motorists for using COVID as an 'excuse' and last year, launching with a laughably obvious IPC-favouring political rant.
