Good evening all,
Firstly thanks in advance for anybody taking the time to read and respond. I have had some really good support in the past, however this situation is unlike the rest.
I parked my car in a PPS (Premier Parking Solutions) car park on 17th October.
There were two machines ti purchase a ticket. The first one would not accept my registration/appeared to have crashed.
As I moved across to the second one, the machine automatically/contactlessley took £5 from my card (of which was in my hand), and spat out a ticket.
I was obviously infuriated that I had been charged £5 when I only needed to pay for up to an hour for what was only going to be a very short meeting.
I put the ticket in the car and attended the meeting, leaving just over half an hour later.
On 31st November (Halloween night) I returned home to the PCN in the post, for not having a valid ticket (no evidence of ticket purchased).
I spoke with my bank and was able to get all of the necessary information pertaining to the transaction, proving that the ticket had been purchased by me, at that location etc, and therefore appealed the ticket.
I wouldn't have done this (or corresponded with them) however as I had bought the ticket, I thought this was the most practical thing to do.
I received a letter today via email rejecting my appeal because I did not enter a valid registration number and that there is no proof that it was my registration that bought that ticket.
I have an idea of how these companies work based on former experience and the advice issued here which again I am again very appreciative of, and so I'm not fearful of the potential barrage of threats, but as this situation is unique based on my purchase of the ticket, I wanted to share it to see if there was any information or advice.
I am happy to share copies of the letters and other information. I did tell them that if they did not come back to me within 14 working days with an apology for wasting my time I would be charging them @ £250 per hour. I figured that in the very unlikely event that it ended up in court, and I was successful, I could fall back on this as a way to tally my losses/damages.

Sounds like a previous driver started to input their numberplate and required parking time, then left the machine for some reason (maybe could not pay). Then you came along and that machine just took £5 for the wrong numberplate already remembered by the machine. I think you paid for someone else's parking due to the machine doing this automatically.

Yes this may be what happened!
No there was no offer to settle, aside from paying the £60, or the escalated £100.
Am I right to just sit it out now or should I appeal?0 -

OK, an IPC firm, therefore there is no second stage appeal worth trying. The IAS is a farce.
Ignore them and collect the DRA letters and laugh at them. Come back in the end if they try a small claim, and update PPS if you move house within 6 years.
One job for you please. This is important and you ONLY chance to stop this happening to others.
We sincerely hope that you are au fait with the need to respond to the final Government Public Consultation?
Hopefully - amongst all the political disruption - it will be open soon but I can see it being published before Xmas, hence why we need everyone to bookmark a certain thread to get email alerts, and come back here to take part.
We all need to ram the nail in the coffin of the false £70 'DRA fee' add-on, that actually funds the court claim and toxic CCJ culture, as well as the DRA gaslighting of people. I use a phone here 95% of the time now! Causes a few typos but no other issues.
The forum looks exactly the same on a phone so there isn't a reason to stop anyone from clicking on the breadcrumb trail my signature tells them is at the top of every page.
I see it right now on my phone, the breadcrumb link back is there at the top, above this thread, same as on a laptop.

Hello,
Happy Christmas to everybody!
I received an email dated 20 December from BW legal regarding this ticket.
This was not one of their "Letter of claim" ones. This was titled "Important message for Mr xxxxx xxxxxxx from BW Legal"
I intended on ignoring all correspondence from PPS until if/when it got to claim stage however there is conflicting info as to whether I respond to this legal company especially as my situation is slightly unique as upon receiving the ticket I did appeal it based on the fact that I had in fact purchased the ticket.
The email is below. I appreciate your time.

Contravention Description: No Trace Of Payment
Contravention Location: xxxxxxxxxx
Date of Contravention: 17 October 2022
Balance Due: £170.00
Our Reference: xxxxxxxxxxxWe have been instructed by Premier Parking Solutions Limited in relation to the balance due for the above Parking Charge Notice (`PCN`). The balance due includes the £100.00 PCN charge, plus our client’s debt recovery costs of £70.00, which were detailed in the PCN and/or our client’s terms and conditions. The terms and conditions were clearly displayed on our client’s signage at the contravention location. As you have failed to either make payment, or raise a valid appeal that resulted in your appeal being upheld, the balance due remains outstanding and we require payment in full by 23 January 2023.
We appreciate this may have been an oversight, or you may have experienced some difficulties that have meant you have not paid our client. We want to work with you to prevent this matter escalating to legal proceedings and if you cannot afford to pay the balance in full, we can find the right repayment plan for you. We have numerous methods available for you to contact us, from our contact centre, webchat and also our Customer Portal. However, if you fail to make payment or contact us to discuss repayment, or provide reasons for non-payment by 23 January 2023, further collections activity (which could be, where relevant, letters, emails, calls, SMS) will continue.

With our client’s authority, we are able to offer a pre-approved monthly repayment plan; we have considered what disposable income you may have available and the amount has been agreed based on what may be affordable for you. You can repay the balance by a pre-approved monthly instalment amount of £15.00 if set up by 23 January 2023.
