If you want your appeal, then ask.

Thanks. They have also not provided with the other stuff. This is what I requested as per the advice on the thread:

    • all photos taken of me/my vehicle
    • -all letters/emails sent and received, including any appeal correspondence
    • -A PDT machine record from the day of the alleged parking contravention
    • -all data held, and all evidence that you will rely on, including a full copy of the PCN notice to keeper
    • -A list of all PCN’s outstanding against me/my VRN (any claim must be for all PCN’s, not several separate claims.

    -

Should I also report them to ICO for withholding information?

Sorry I just want to make sure I do everything as it should be done

I wonder if this a sufficient response:

    Good morning,

Thank you for your email, however I regret to inform you that you have failed to provide a complete subject access request, which means that you have therefore purposefully withheld information, which is a breach of GDPR.

Although I was very clear and unequivocal in my request, I will give you a final opportunity to provide the information that I have requested to satisfy my Subject Access Request.

This is now the second time that you have been difficult. If you fail to cooperate and provide a complete disclosure of information then I can confirm that I will be reporting you to the ICO for clear breaches.

To help you, I again include the information that I have requested below:
    • all photos taken of me/my vehicle
    • all letters/emails sent and received, including any appeal correspondence
    • A PDT machine record from the day of the alleged parking contravention
    • all data held, and all evidence that you will rely on, including a full copy of the PCN notice to keeper
    • A list of all PCN’s outstanding against me/my VRN (any claim must be for all PCN’s, not several separate claims.
    - You have not provided me with me my original appeal and appeal correspondence

    - You have not provided me with a list of PCNs outstanding against me/confirmation that this is the only one

    - You have not provided me with any/all photos taken of me/my vehicle

    - You have not provided me with a PDT machine record from the day of the alleged parking Contravention

    - You have not provided me with the evidence that you will rely on including the notice to keeper

    Yours sincerely

Not sure they have to provide you with anything that is not your data such as PDT info. Of course, if you have evidence of the data they haven't provided such as a copy of your appeals etc., then you can go after them with the ICO.

However, none of this "Good morning" !!!!!!. You are dealing with scamming bottom-dwellers and you need to be completely formal with them. It's "Dear Sir" and "Yours faithfully". They are not your mates.

Thank you very much for your reply. I kept the email in drafts so I have removed the pleasantries as advised and sent.

I wasn't sure about the PDT info but it said in the thread to ask for this and to maintain that you want it so thought it was worth mentioning.

Let's see what they come back with.

I'm not entirely sure what I do now they have responded, and what I do with BW Legal as they have not responded.

Respond to what? Did you also SAR BWL?

You don't need to SAR the solicitor, but you could ask them for the PDT machine logs under your rights under the pre-action protocol for debt claims.

Hello, thank you. So I am clear, were you saying I can request this from the solicitors? I have asked PPS for it in the original SAR and have re-requested that tonight.

    Thanks

Hello, I emailed them to inform them of my SAR, so I thought they may have to acknowledge it.

Yep, read the Pre-action Protocol for debt claims (the PAP) and you will see your right to ask for the documents their client will rely on.

    Completely separate from a SAR.
