Thank you so much for your reply on my thread https://forums.moneysavingexpert.com/discussion/6390505/civil-enforcement-claim-form#latest
I am currently compiling my defence, I have until Monday 17th October to file a defence.
@Ed2022 do you have any advice on what else I should do alongside my defence? I can see that you've gone to the trouble of emailing the landowners, do you think I should do that too? I can see from your thread they have been no help whatsoever, but it may be worth trying and support my defence?
Many thanks

I can see that you've gone to the trouble of emailing the landowners, do you think I should do that too? That's Plan A. Can often work. But, if you don't ask, you'll never know if it will work! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Perhaps both of you might wish to contact local or national media outlets to warn people what the landowner's are allowing to happen, if not encouraging by their own inaction. In my opinion the actions of this ex-clamper company and this ex-Wonga official who worked for a company being investigated by the police should be brought to the attention of the public.
The landowner might decide to change their tune if they are asked embarrassing questions by journos.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks3 -

Complain to the landowner to tick that box. Also the local MP. Your local MP if a different constituency.
Replied in your threat. What @Fruitcake had said re:Fruitcake said:This is the point I was trying to make on the other threads as I posted here: -
Parking Charge Notice Received from 4 years ago!!! - Page 2 — MoneySavingExpert Forum
The address given on the NTK is not the physical address of the car park, therefore the NTK does not comply with the PoFA because it does not define the relevant land where the alleged event took place.
Photos/GSV images of the address on the NTK quite clearly show that it is a two-storey building with no car park at that location.
There is a lot more I could say but shall be diplomatic.
=============================================
I've received my SAR from CEL - no signage, only the number place of the vehicle but no indication of location. It looks like a screenshot from a CCTV camera.
Two questions from the SAR garbage they sent:
1. "Incident" was 21/07/2018 but Parking charge was 06/09/2018 - doesn't this invalidate it?
2. Reading this statement below in the SAR pack, the 1st letter dated 06/09/2018 (CEL), the 2nd 08/10/2018 (from CEL), 3rd 11/12/2018 (from ZZPS on behalf of CEL) and 4th 31/12/2018 (again ZZPS on behalf of CEL).
Nothing then this has been sent over 3 years later. Sitting on my data for 3 years and going from CEL to ZZPS then back to CEL. As a data controller does that sound right?

Nothing invalidates a NTK.
I haven't read back, but if a NTD was left on the vehicle, then the date of the NTK is PoFA compliant, although the wording may not.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks2 -

Did the NTK allege that a NTD had been left?
If not, then the NTK was non PoFA complaint and incapable of holding the keeper liable.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks2 -

Okay thats great. Also the appeal terms are as below. I would have thought an appeal would freeze the invoice than revert back to the full bill?
Lastly the IPCI Ltd in their correspondence advised they "could only" cancel up to 10-days. Given the NTK has come 1.5 months thereafter how can this even be? Is it worth emailing the idiotic landlords again?

It's not a bill and no-one here looks at the discount, or gives any thought to whether it's re-offered or not! You won't be paying it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
