PCN with County Court N1 form (Civil Enforcement Limited)

Good evening

Seems I have another one from this odious company.

PCN with County Court N1 form (Civil Enforcement Limited).

Timeline:
  • 21/07/2018 - Parking incident
  • 19/09/2018 - Payment due
  • 23/09/2022 - CCBC form received (attached)
  • 23/09/2022 - Made a CPR 31.14 request / SAR sent / without prejudice settlement
  • 23/09/2022 - Email the car park, The Community Centre (& will visit the car park administrators also in person.)
I couldn't find the email address for these swines on their website, intentional I suspect so found it on this website here and so posted it here;
Will await responses from the emails.

Will use the same template on the pinned link once I get the further information.

Thanks.

Kind regards

Ed

With a Claim Issue Date of 22nd September, you have until Tuesday 11th October to file an Acknowledgment of Service. Do not file an Acknowledgment of Service before 27th September, but otherwise there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 25th October 2022 to file your Defence.
That's well over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

What happened when you complained to the landowner and your MP? That is always Plan A and it is never too late to do it.

Where did the alleged event occur? It may have cropped up here before.

The car park is unfortunately in a "delightful" area in Birmingham, 426-428 coventry road.

I am awaiting a reply from the land owner.

    And will contact the MP.

Note the comments I made on the 31st of March on that thread regarding the fact that there is no car park at that specific address.

They have stated the place of the alleged transgression as 'Islamic Place of Worship'.
Is that sufficiently detailed to tell anyone where in the world it happened?

We have seen this before - just a few months ago.
Although apparently not yet concluded, this thread, or the author of it, may help...

There are also comments on that thread by @Fruitcake which also mention the vague car park address - see here.

Why not get in touch with @Waqy1 and find out how he's getting on?

That claim's Particulars are a dog's dinner.  Not only about the unidentified location.

There is nothing to say what term was breached and no breakdown of the £182 claimed. Given the maximum parking charge is £100 in the BPA Code of Practice, the POC should state the £100 and explain the false/extortionate £82 add-on as a separate head.  And given the maximum parking charge is £100 why is (ex-Wonga failure) Scott Wilson trying for interest - from day one - on £182?

Thanks gents - i only assumed it was the unity centre given the signage on Google although when I log into the CEL online portal it has the address as 426-428 coventry road.

    @Coupon-mad is certainly no gentleman!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
